Justice department has no powers to review Jub Jub's court judgement

The South Africans Against Drunk Driving organisation has called on the Department of Justice and Constitutional Development to review the South Gauteng High Court judgment. The organisation’s spokesperson, Caro Smit, has been quoted calling for the Department to review the decision of the South Gauteng High Court on the matter involving the State and Mr Molemo “Jub Jub” Maarohanye and Themba Tshabalala.

It is important to note that the department does not have powers to review the decisions of the court. The department respects the independence of the judiciary as enshrined in the Constitution. The decisions of the court are binding and may only be reviewed by a higher court.

We understand the disappointment and stress by some members of the public at the reduced sentences, but it is up to the prosecuting authority to appeal that judgment if there are valid grounds.
