The Independent Complaints Directorate (ICD) wishes to inform that Inspector
Skhimbuso Paul Mdluli (38) who was stationed at South African Police Service
(SAPS) Tongaat, KwaZulu-Natal, was convicted of murder in the Durban High Court
on Friday, 28 July 2006.
The incident which claimed the life of his wife, Rosemary Numusa Banda (36)
occurred in April 2002 in Tongaat. It is alleged that Inspector Mdluli
requested his 11 year old son to fetch his private firearm, a CZ 83, which he
later used to shoot at his wife and then himself after a domestic quarrel. The
victim was shot in the head above the right eye and died instantly. Inspector
Mdluli was taken to St Augustine hospital where he recovered.
The ICD immediately took charge of the investigation and on finalisation
thereof, forwarded the case docket to the Director of Public Prosecutions (DPP)
with a recommendation that Inspector Mdluli be prosecuted for murder. The DPP
accepted our recommendation.
Inspector Mdluli who was out on bail, was convicted of murder and sentenced
to 15 years' imprisonment at the Durban High Court on Friday, 28 July 2006.
Furthermore, he will only be eligible for parole after serving seven years.
The ICD wishes to reiterate that any involvement of police officers in
unlawful behaviour will not be tolerated.
