The Department of Health respects the dignity of the court of law and the
independence of the judiciary. The department has complied with every court
ruling relating to its function areas and will continue to do so.
Regarding comments on the ruling of Judge Jahbay on the matter between
Tshabalala-Msimang and Sunday Times our comment is as follow:
* when presenting his ruling at the Johannesburg High Court, the judge
stated that everyone was welcome to study the ruling and to comment or
criticise it.
It was within this context that the department expressed its concern about
use of public interest argument to justify the infringement of the law of
parliament.
