MEC Carlisle hails Chapman's peak court decision

Judge Bennie Griessel handed down his judgement in the latest application brought by the Hout Bay Residents Association and the Habitat Council to stop the construction of the Chapman’s Peak control centre.

Judge Griessel dismissed the application and made no order as to costs. The ruling follows the dismissal by Judge J Allie of a similar application by the same organisations two months ago.

"It is clear from the judgement that Judge Griessel applied his mind without prejudice. The Judge dissected the arguments put forward by the HBRA and Habitat Council for what they were: a last ditch effort to stop tolling disguised as environmental concerns," said Carlisle.

"Construction continues, and will be completed in May 2013. Chapman's Peak will thus continue to be the safest we can make it, and will continue to bring the natural world to ordinary people for generations to come," added Carlisle.
