Hospitality workplace inspections for KwaZulu-Natal

The department's drive to increase labour law awareness and compliance will
next week shift to the hospitality sector in KwaZulu-Natal province. The
week-long inspections starting on Monday 6 August 2007 will see labour
inspectors visiting hotels, motels, inns, resorts, game lodges, guest farms,
bed and breakfast establishments, timeshares, camps, caravan parks,
restaurants, pubs, taverns, cafes, coffee shops, fast food outlets, snack bars
and commercial, function or contract caterers throughout the province.

Employers in the industry are warned to have their house in order when it
comes to the conditions of employment as stipulated in the hospitality sectoral
determination. Officials will be scrutinising employment records relating to
hours of work, leave, particulars of employment and adherence to the prescribed
minimum wages that employers are required to pay their workers.

The newly promulgated sectoral determination which came into effect on 1
July 2007, for workers in establishments that employ less than 10 workers is
set at R1 480 per month or R7,59 an hour and for those in establishments
employing more than 10 employees, is R1 650 per month or R8,46 an hour.

The legislation further stipulates that workers paid on a commission (not
tips) basis should at least earn the minimum wage. Gratuities (tips) should not
form part of the minimum wage. Sunday work in the sector should be paid either
at 1,5 or double the ordinary rate depending on whether the employee ordinarily
works on a Sunday or not as outlined in the Basic Conditions of Employment
Act.
