The Department of Environmental Affairs and Development Planning issued a positive environmental authorisation for a residential development on ERF 3477, Hout Bay, on 12 October 2010.
In terms of the National Environmental Management Act, the applicant must notify all registered interested and affected parties of their right to submit a notice of intention to appeal succeeding the decision of the Department of Environmental Affairs and Development Planning issued on 12 October 2010. The applicant notified the registered interested and affected parties on 12 October 2010 and the period for the lodging of Notices of Appeal concluded on 22 October 2010 at midnight.
Twelve (12) notices of intention to appeal have been received by the Department of Environmental Affairs and Development Planning. Affected parties who were not registered as interested and affected parties and who wish to appeal may petition the provincial minister to extend the period within which to serve their notice of intent to appeal. Such parties are to provide details motivating as to why they were not registered as interested and affected parties during the application process and the reasons as to why the Provincial Minister should grant their requested extension.
The appeal submissions must be submitted on an official appeal form to the provincial minister within 30 days of the lodging of the Notices of the Intention to Appeal. The prescribed Notice of Intention to Appeal forms as well as the appeal forms are available online at http://www.capegateway.gov.za/eadp.
