Stock Theft Amendment Act,1990 (No. 28 of 1990)

Act

  • to amend the Stock Theft Act, 1959, so as
  • to make further provision for the furnishing of particulars on the document of identification;
  • to extend the period for which certain documents shall be retained;
  • to make further provision for the furnishing of particulars on the removal certificate;
  • to increase certain fines; and
  • to increase the amount or compensation for damage to or loss of stock or produce; and 
  • to provide for matters connected therewith.

BE IT ENACTED by the State President and the Parliament of the Republic of South Africa, as follows:-

Amendment of section 6 of Act 57 of 1959, as amended by section 3 of Act 59 of 1983

1. Section 6 of the Stock Theft Act, 1959 (hereinafter referred to as the principal Act), is hereby amended-

(a) by the addition to paragraph (a) of subsection (1) of the following subparagraphs:

"(iii) the full name and address of the person to whom the stock was sold, bartered, given or disposed of;

(iv) the date on which the stock was sold, bartered, given or disposed of;"; and

(b) by the substitution for subsections (3) and (4) of the following subsections,respectively: 

"(3) Any person to whom a document of identification has been furnished in terms of subsection (1) shall retain it in his possession for a period of at least [three months] one year.

( 4) Any person may within the [said three months] period referred to in subsection (3) demand an inspection of such document, and upon such deman t e person having possession of such document shall produce it for inspection to the person making the demand.".

Amendment of section 7 of Act 57 of 1959, as substituted by section 4 of Act 59 of 1983

2. Section 7 of the principal Act is hereby amended by the substitution for subsections (2) and (3) of the following subsections, respectively:

"(2) Any person who has obtained such a certificate shall retain it in his possession for a period of at least [three months] one year.

(3) Any person may within the [said three months] period referred to in subsection (2) demand an inspection of such certificate, and upon such demand the person having possession of such certificate shall produce it for inspection to the person making the demand.".

Amendment of section 8 of Act 57 of 1959, as amended by section 5 of Act 59 of 1983

3. Section 8 of the principal Act is hereby amended-

(a) by the substitution for paragraphs (e) and (f) of subsection (1) of the following paragraphs: ·

"(e) the name of the driver, conveyer or transporter; [and]

(f) the date of issue thereof; and 

(g) if applicable, the registration number, model and make of the vehicle with which the stock or produce is being conveyed or transported:"; and 

(b) by the substitution for subsections (6) and (7) of the following subsections, respectively: .

"(6) Any person who has obtained such a document as is referred to in subsection (4) shall retain it in his possession for a period of at least one [month] year.

(7) Any justice of the peace, policeman, or owner, lessee or occupier of land, may within the [said month]  period referred to in subsection (6), demand an inspection of such document, an upon sue eman t e person having possession of such certificate shall produce it for inspection to the person making the demand.". 

Amendment of section 13 of Act 57 of 1959, as amended by section 6 of Act 59 of 1983 and section 1 of Act 32 of 1986

4. Section 13 of the principal Act is hereby amended by the substitution in subparagraph (v) of paragraph (a) for the expression "R4 000" of the expression "R8 000".

Amendment of section 14 of Act 57 of 1959, as substituted by section 2 of Act 32 of 1986

5. Section 14 of the principal Act is hereby amended by the substitution for the expression "R2 000" of the expression "R4 000".

Amendment of section 15 of Act 57 of 1959, as substituted by section 8 of Act 59 of 1983 

6. Section 15 of the principal Act is hereby amended by the substitution in paragraph (b) for the expression "R10 000" of the expression "R20 000".

Short title

7. This Act shall be calJed the Stock Theft Amendment Act, 1990.
