Scientific Research Council Amendment Act, 1990 (No. 71 of 1990)

Act

  • to amend the Scientific Research Council Act, 1988, so as
  • to alter the objects, functions and powers of the CSIR; to alter the constitution of the Board thereof; and 
  • to further define the duties and responsibilities of the accounting officer thereof; and 
  • to provide for matters connected therewith.

BE IT ENACTED by the State President and the Parliament of the Republic of South Africa, as follows:- ·

Amendment of section 1 of Act 46 of 1988

1. Section 1 of the Scientific Research Council Act, 1988 (hereinafter referred to as the principal Act), is hereby amended by the substitution for the definition of "research" of the following definition:

"research" means the augmentation and improvement of knowledge trhough scientific investigations and methods directed towards the scientific and technological requirements of the private and public sectors, including the solution of relevant problems in the national interest, and includes the development, acquisition and transfer of expertise and technology;".

Substitution of section 3 of Act 46 of 1988

2. The following section is hereby substituted for section 3 of the principal Act:

"Objects of CSIR

3. The objects of the CSIR are, through directed and particularly multi-disciplinary research and technological innovation, to foster, in the national interest and in fields which in its opinion should receive preference, industrial and scientific development, either by itself or in co-operation with principals from the private or public secors, and thereby to contribute to the improvement of the quality of life of the people of the Republic, and to perform any other function that may be assigned to the CSIR by or under this Act.".

Amendment of section 4 of Act 46 of 1988

3. Section 4 of the principal Act is hereby amended-

(a) by the substitution for paragraph (c) of subsection (1) of the following paragraph:

"(c) foster the traning of its manpower [research workers and to that end grant bursaries for research, and make monetary contributions for research programmes];";

(b) by the substitution for paragraph (f) of the said subsection (1) of the following paragraph:

"(f) [promote co-operation between the Republic and other countries in matters relating to research] co-operate with State departments, societies, institutions and other persons that are nationally or internationally involved in research."; and

(c) by the substitution for subsection (4) of the following subsection:

"(4) For the achievement of its objects contemplated in section 3, the CSIR may in the field of research co-operate with departments of State, universities, technikons, colleges, scientific institutions and other persons.".

Amendment of section 7 of Act 46 of 1988

4. Section 7 of the principal Act is hereby amended by the substitution for subsection (2) of the following subsection:

"(2) The Board shall consist of-

(a) a chairman, appointed by the Minister after consultation with the Board [Provided that in the case of the first Board, only the Minister shall appoint such chairman];

(b) not fewer than five but not more than nine other members, [of whom at least one occupies a senior managerial post at a tertiary educational institution,] appointed by the Minister; and

(c) the president, who shall serve on the Board by virtue of his office.".

Substitution of section 16 of Act 46 of 1988

5. The following section is hereby substituted for section 16 of the principal Act:

"Accounting officer

16. In addition to the other functions and duties entrusted to him by this Act, the president shall be the accounting officer charged with the responsibility of accounting for all money received, [and for all payments made by] the utilization thereof and the use and care of the property of the CSIR.".

Short title and commencement

6. This Act shall be called the Scientific Research Council Amendment Act, 1990, and shall come into operation on a date fixed by the State President by proclamation in the Gazette.
