The Regional Services Councils Amendment Act 49 of 1988 intends:

  • to amend the Regional Services Councils Act, 1985, so as
  • to define or further define certain expressions;
  • to grant to the Administrator the power to perform certain acts if a local authority refuses or fails to do so;
  • to delete certain references;
  • to further regulate the powers and duties of a regional services council;
  • to further regulate the constitution of a council, the election of a deputy chairman and the apportionment of votes in a council;
  • to provide for the remuneration of a member of a committee who is not a member of the council;
  • to provide that interested persons be allowed to attend the proceedings of a committee of the council;
  • to provide that the standing orders may regulate the manner of voting in certain instances and may prescribe penalties for any contravention of the standing orders;
  • to provide that the deputy chairman will, in the absence of the chairman or at his request, be an ex officio member of a committee;
  • to provide for the appointment of an executive committee of a council and to regulate matters regarding such committee;
  • to make further provision for the reconsideration of decisions, and appeal;
  • to further regulate the powers of a council to delegate;
  • to further regulate the financing of a council;
  • to provide for the establishment of rural councils;
  • to provide for the auditing of the accounts of a council;
  • to delete the requirement that employees of a council take an oath of secrecy;
  • to grant to the Minister and to the Minister of Finance the power to make regulations to remove conflict with other laws, or administrative problems; and
  • to extend the provisions concerning laws being repealed; and
  • to provide for matters connected therewith.
