Act

  • to amend the Public Holidays Act, 1994, so as to empower the President to declare any day to be a public holiday; and
  • to provide for matters connected therewith.

BE IT ENACTED by the Parliament of the Republic of South Africa, as follows:-

Amendment of section 1 of Act 36 of 1994

1. Section 1 of the Public Holidays Act, 1994 (hereinafter referred to as the principal Act), is hereby amended by the substitution in subsection (1) for the definition of "public holidays" of the following definition:

" 'public holidays' means the days mentioned in Schedule 1 and any other day declared to be a public holiday under section 2A;".

Insertion of section 2A in Act 36 of 1994

2. The following section is hereby inserted in the principal Act after section 2:

"Declaration of public holidays

2A. The President may by proclamation in the Gazette declare any day to be a public holiday throughout the Republic or any part thereof.". 

Short title

3. This Act shall be called the Public Holidays Amendment Act, 1995.
