BE IT ENACTED by the State President and the Parliament of the Republic of South Africa, as follows:-

Amendment of section 26 of Act 6 of 1981.

1. Section 26 of the Prevention and Combating of Pollution of the Sea by Oil Act, 1981, is hereby amended by the substitution for paragraph (a) of subsection (2) ofthe following paragraph:

"(a) as a charge to the [State Oil] Central Energy Fund referred to in section 1 (1) of the [State Oil] Central Energy Fund Act, 1977 (Act No. 38 of 1977), [an amount calculated at the rate of 0,055 cents per litre of the customs or excise duty referred to in section 1 (1) (a) (ii) of the said Act or] such [higher] amount as the Minister of [Industries, Commerce and Tourism] Mineral and Energy Affairs may, with the concurrence of the Minister[approve in terms of the provisions of section 1 (2) (a) (ii) of the said Act] from time to time determine;".

Short title and commencement.

2. This Act shall be called the Prevention and Combating of Pollution of the Sea by Oil Amendment Act, 1985, and shall be deemed to have come into operation on 24 April1985.
