Petroleum Products Amendment Act, 1991 (No. 68 of 1991)

Act

  • to amend the Petroleum Products Act, 1977, so as
    • to amend the definition of "Minister";
    • to further regulate the power of the Minister to prescribe the price at which petroleum products may be sold; and
    • to rectify or delete certain outdated references; and
  • to provide for incidental matters.

BE IT ENACTED by the State President and the Parliament of the Republic of South Africa, as follows:-

Amendment of section 1 of Act 120 of 1977, as amended by section I of Act 61 of 1985

1. Section 1 of the Petroleum Products Act, 1977 (hereinafter referred to as the principal Act), is hereby amended-

(a) by the substitution for the definition of "Minister" of the following
definition:

"'Minister' means the Minister of Mineral and Energy Affairs and Public Enterprises;"; and

(b) by the deletion of the definition of ''Republic".

Amendment of section 2 of Act 120 of 1977, as amended by section 1 of Act 72 of 1979 and section 2 of Act 61 of 1985

2. Section 2 of the principal Act is hereby amended by the substitution for paragraph (c) of subsection (1) of the following paragraph:

"(c) prescribe the price, or a maximum or minimum price, or a maximum and minimum price, at which any petroleum product may be sold by any person;".

Substitution of section 10 of Act 120 of 1977

3. The following section is hereby substituted for section 10 of the principal Act:

"Construction of reference in Criminal Procedure Act, 1977, to certain amounts

10. In the application of sections 56, 57 and 112 of the Criminal Procedure Act, 1977 Act No. 51 of 1977 , in respect of an offence under this Act, any reference in any such section to an amount of R300 shall be construed as a reference to an amount of R500.".

Amendment of section 11 of Act 120 of 1977, as amended by section 4 of Act 72 of 1979 and section 7 of Act 61 of 1985

4. Section 11 of the principal Act is hereby amentled by the substitution for subparagraph (ii) of paragraph (a) of the following sutiparagraph:

"(ii) a provincial administration [(including the Administration of South West Africa)];".

Repeal of section 13 of Act 120 of 1977

5. Section 13 of the principal Act is hereby repealed:

Substitution of long title of Act 120 of 1977, as substituted by section 6 of Act 72 of 1979

6. The following long title is hereby substituted for the long title of the principal Act:

"ACT

To provide measures for the saving of petroleum products and an economy in the cost of the distribution thereof, and for the rrii!intenance and control of a price therefor; for control of the furnishing of ceftain information regarding petroleum products; and for the rendering of services of a particular kind, or services of a particular standard, in connection with motor vehicles; and to provide for matters incidental thereto.".

Short title

7. This Act shall be called the Petroleum Products Amendment Act, 1991.
