Non-Proliferation of Weapons of Mass Destruction Amendment Act, 1996 (No. 59 of 1996)

Act

  • to amend the Non-Proliferation of Weapons of Mass Destruction Act, 1993, so as
    • to make provision for the representation of the Department of Trade and Industry in the South African Council for Non-Proliferation of Weapons of Mass Destruction; and
    • to render punishable any contravention of, or any failure to comply with, the provisions of a certain notice or the conditions of a certain permit; and
  • to make provision for matters connected therewith.

BE IT  ENACTED by the Parliament of the Republic of South Africa, as follows:- 

Amendment of section 4 of Act 87 of 1993, as amended by section 1 of Act 50 of 1995

1. Section 4 of the Non-Proliferation of Weapons of Mass Destruction Act, 1993 (hereinafter referred to as the principal Act), is hereby amended by the substitution for paragraph (b) of subsection (2) of the following paragraph:

"(b) an officer of the Department of Foreign Affairs, designated by the Minister of Foreign Affairs, and an officer of the Department, designated by the Minister;".

Amendment of section 26 of Act 87 of 1993

2. Section 26 of the principal Act is hereby amended by the substitution for paragraph (c) of subsection (1) of the following paragraph:

"(c) contravenes or fails to comply with the provisions of a notice issued under section 13(2) or (9), or the conditions of a penn it referred to in section 13(2), read with section 13(4), or the provisions of section 13(3) or 15(1);".

Short title

3. This Act shall be called the Non-Proliferation of Weapons of Mass Destruction Amendment Act, 1996.
