The Mineral and Petroleum Resources Development Amendment Act 49 of 2008 intends:

  • to amend the Mineral and Petroleum Resources Development Act, 2002, so as
    • to make the Minister the responsible authority for implementing environmental matters in terms of the National Environmental Management Act, 1998 and specific environmental legislation as it relates to prospecting, mining, exploration, production and related activities or activities incidental thereto on a prospecting, mining, exploration or production area;
    • to align the Mineral and Petroleum Resources Development Act with the National Environmental Management Act, 1998 in order to provide for one environmental management system;
    • to remove ambiguities in certain definitions;
    • to add functions to the Regional Mining Development and Environmental Committee;
    • to amend the transitional arrangements so as to further afford statutory protection to certain existing old order rights; and
  • to provide for matters connected therewith.

7 June 2013 (Gazette 36512 of 31 May 2013) except Section 11(1) (Gazette 36541 of 6 June 2013)
