Act

  • to amend the Merchant Shipping Act, 1951, in order to extend the powers of the Minister in respect of the disposal of wrecks or ships that have been wrecked, stranded or abandoned.

Be it enacted by the State President, the Senate and the House of Assembly of the Republic of South Africa, as follows:-

Amendment of section 304A of Act 57 of 1951, as inserted by section 9 of Act 5 of 1976.

1. Section 304A of the Merchant Shipping Act, 1951, is hereby amendc:d by the substitution for subsection (2) of the following subsection: 

''(2) [If] The Minister [is of the opinion that any wreck or any wrecked, stranded or abandoned ship constitutes a danger or potential danger to navigation in the territorial waters of the Republic, he] may, notwithstanding the provisions of subsection (1), cause [such] any wreck or any wrecked, stranded or abandoned ship or any part thereof to be ra1sed, removed or destroyed or dealt with in such manner as he may deem fit.".

Short title.

2. This Act shall be called the Merchant Shipping Amendment Act, 1978.
