Merchandise Marks Amendment Act,1954 (No. 47 of 1954)

Act

to amend the Merchandise Marks Act, 1941.

Be it enacted by the Queen's Most Excellent Majesty, the Senate and the House of Assembly of the Union of South Africa, as follows:-

Amendment of section 1 of Avt 17 of 1941, as amended by section 1 of Act 39 of 1952

1. (1) Section one of the Merchandise Marks Act, 1941 (hereinafter referred to as the principal Act), is hereby amended by the addition at the end of the definition of "sell" of the 
words ", and the word 'sale' has a corresponding meaning;". 

(2) Sub-section (1) shall be deemed to have come into operation on the eighteenth day of October, 1941.

Amendment of section 4 of Act 17 of 1941

2. Section four of the principal Act is hereby amended by the addition thereto of the following sub-section:
"(4) No compensation shall be payable in respect of any damage caused to any goods by any person in the exercise of his powers under this section, unless it is proved that such damage could have been avoided by the exercise of reasonable care.".

Short title.

3. This Act shall be called the Merchandise Marks Amendment Act, 1954.
