19 of 1985

The Magistrates' Courts Amendment Act 19 of 1985 intends:

  • to amend the Magistrates' Courts Act, 1944, so as
    • to provide that the rules made by the Rules Board shall be tabled in the respective Houses of Parliament;
    • to increase the maximum amounts of certain fines which may be imposed in terms of that Act;
    • to replace references to the Criminal Procedure Act, 1955, by references to the Criminal Procedure Act, 1977, and to replace references to sections of the former Act by references to the corresponding sections of the latter Act; 
    • to increase the amount of a judgment debtor's total debts with reference to which a power is conferred upon the court to grant an administration order in respect of the judgment debtor's estate; and
    • to increase the extent of the exemption in relation to those classes of property which are to a limited extent exempt from execution; and
  • to provide for incidental matters.
