Local Councils Amendment Act, 1990 (No. 51 of 1990)

Act
- to amend the Local Councils Act (House of Assembly), 1987, so as
- to adjust the definition of Minister; and
- to authorize the Minister of the Budget and Local Government to assign certain functions to certain officers; and
- to provide for matters connected therewith.

BE IT ENACTED by the State President and the House of Assembly of the Republic of South Africa, as follows:-
Amendment of section 1 of Act 94 of 1987
1. Section 1 of the Local Councils Act (House of Assembly), 1987, is hereby amended by the substitution for the definition of "Minister" of the following definition:
"'Minister' means the Minister in the Ministers' Council of the House of Assembly charged with local government matters;".
Insertion of section 6A in Act 94 of 1987
2. The following section.is hereby inserted in the Local Councils Act (House of Assembly), 1987, after section 6:
"Minister may assign certain functions to officers
6A. (1) The Minister may delegate or assign to an officer in the department of State administered by him, any power or duty entrusted to the Minister by regulation under section 6.
(2) A person to whom a power or duty has been delegated or assigned under subsection (1) shall exercise that power and perform that duty subject to the directions of the Minister.".
Short title
3. This Act shall be called the Local Councils Amendment Act (House of Assembly), 1990.
