Industrial Development Amendment, 1964 (No. Act 52 of 1964)

to amend the Industrial Development Act, 1940.

Be it enacted by the State President, the Senate and the House of Assembly of the Republic of South Africa, as follows:-

Amendment of section 1 of Act 22 of 1940, as amended by section 1 of Act 67 of 1961.

1. Section one of the Industrial Development Act, 1940 (hereinafter referred to as the principal Act), is hereby amended-

(a) by the deletion in the definition of "private shareholders" of the worrds "of the union"; and

(b) by the addition of the following definition:
"'Republic" includes the territory of South-West Africa.".

Amendment of section 2 of Act 22 of 1940.

2. Section two of the principal Act is hereby amended-

(a) by the substitution in sub-section (1) for all the words before the words "a body" of the words "There shall be"; and

(b) by the substitution in sub-section (2) for all the words before "Registrar" of the word "The".

Amendment of section 4 of Act 22 of 1940, as amended by section 2 of Act 67 of 1961.

3. Section four of the principal Act is hereby amended by the substitution in paragraph (h) for the words "outside the Union" of the words "in any country or territory".

Amendment of section 11 of Act 22 of 1940.

4. Section eleven of the principal Act is hereby amended by the substitution in sub-section (3) for all the words before the word "appointments" of the word "All".

Amendment of section 12 of Act 22 of 1940, as amended by section 3 of Act 27 of 1942.

5. Section twelve of the principal Act is hereby amended-

(a) by the deletion in sub-section (2) and in sub-section (3) of the words "of the Union"; and

(b) by the deletion in sub·section (4) of the proviso thereto.

Amendment of section 14 of Act 22 of 1940.

6. Section fourteen of the principal Act is hereby amended by the deletion in the proviso thereto of the words "of the Union".

Substitution in Act 22 of 1940 for the words "Union" and "Govemor-General" of the words "Republic" and "State President", respectively.

7. Subject to the preceding provisions of this Act, the principal Act is hereby amended by the substitution for the word "Union" wherever it occurs, of the word "Republic", and for the word "Govemor-General", wherever it occurs, of the words "State President".
