Gill College Corporation Private Act, 1912 [No. 6 of 1912] 

Private Act

to enable the Gill College Corporation to apply certain income now accruing to the corporation in the creation of bursaries.

(Assented to 20th May, 1912.)

Preamble

Wheras under the will of the late Doctor WILLIAM GILL of Somerset East, it was provided that the residue of his estate after payment of certain legacies should he invested and the aminal interest arising therefrom should be applied by certain persons known as the Gill College Corporation, in the formation and maintenance of an Institution for Public Education at some convenient place in the Eastern Province to he by them or the majority of them selected, and whereas it was further provided that the said Corporation in framing rules for the direction of the said Educational Institution should be guided as far as local circumstances admitted by those of the University of Glasgow:

And whereas the said Corporation in the execution of their trust did select the town of Somerset East as a convenient place and did establish and maintain there an Institution for Public Education in accordance with the provisions of the said will: 

And whereas the Governor of the late Colony of the Cape, of Good Hope did by deed under his hand and the Public Seal under date the 16th day of April, 1867, grant to the said Corporation a certain piece of land situated in Somerset East in the said deed fully described, on condition that the said land should be used as a site for the erection· of buildings for the accommodation of the aforesaid Institution and for no other purpose whatsoever: 

And whereas the said Corporation with funds provided by public subscription and otherwise obtained did erect buildings upon the land so granted:

And whereas it has been found impossible to continue longer to carry on the aforesaid institution in accordance with ihe provisions of the said will:

And whereas the intentions of the testator and of the contributors to the funds provided by public subscription and otherwise and the intentions under which the grant of the piece of land aforesaid was made, can now be best carried into effect by enabling the said Corporation to apply the available net annual income accruing to them in providing bursaries for the purpose of assisting students from the Gill High School or a High School for Girls in Somerset East in prosecuting their studies at some other place in or out of the Union of South Africa:

Be it enacted by the King's Most Excellent Majesty, the Senate and the House of Assembly of the Union of South Africa, as follows:-

Gill College Corporation empowered to grant bursaries to former studens of Gill High School and females attending a Girls High School in Somerset East, who are prosecuting their studies elsewhere.

1. It shall be lawful for the Gill College Corporation notwithstanding anything contained in the will of the late Doctor William Gill, dated 19th January, 1863, and the codicils thereto, out of the available net annual income accruing to them to grant bursaries according to the regulations set out in the Schedule hereto to students prosecuting their studies elsewhere than in the town or district of Somerset East, whether within or without the Union of South Africa : Provided however that such bursaries shall be granted only to students who have passed the Matriculation Examination or the University Senior Certificate Examination of the University of the Cape of Good Hope, or some examination of equal grade and who immediately prior thereto being males have attended the classes of the Gill High School for not less than two years or being females have attended a High School for Girls in Somerset East for not less than two years: Provided further that such bursaries
be called "Dr. Gill Bursaries".

Alteration and amendment of Regulations

2. It shall be lawful for the said Corporation with the approval of the Governor-General-in-Council to vary, alter or amend from time to time the Regulations in the Schedule hereto.

Short title

3. This Act may be cited as the Gill College Corporation Private Act, 1912.

Schedule

Regulations for the allocation of bursaries under the First Section of the Act.

Annual Awards.

1. As many bursaries as the available funds will allow shall be awarded annually.

How payable.

2. The bursaries shall be payable in quarterly instalments.

Tenure.

3. The bursaries shall be tenable for three years.

Method of award.

(4) The bursaries shall be awarded annually to students who have passed the Matriculation Examination or University Senior Certificate Examination of the University of the Cape of Good Hope or some examination of equal grade in order of prefereuce according tc the aggregate of their individual marks : Provided however that the Corporation shall have discretion to give preference irrespective of his or her aggregate of marks to any student who has passed such examination who without the assistance of a bursary would be unable to pursue his or her studies elsewhere.

Continuance of study.

5. Bursars shall during the tenure of their bursaries continue their studies at some Institution approved of by the Corporation with a view to passing some higher examination.

Corporation may suspend payment in certain circumstances.

6. The Corporation shall have power to withhold or suspend payment of any bursary unless the Bursar shall produce a certificate of satisfactory conduct and progress prior to each quarterly payment becoming due.

Application for bursaries.

7. Application for bursaries shall be made to the Secretary of the Corporation before 1st March in each y ear.

Commencement of study.

8. Bursars shall commence their studies within six months from the date of allocation of the bursary.
