Act

to amend the Fencing Act, 1963, so as to further define "holding", "Minister" and "owner".

Be it enacted by the State President, the Senate and the House of Assembly of the Republic of South Afnca, as follows:- 

Amendment of section 1 of Act 31 of 1963.

1. Section 1 of the Fencing Act, 1963, is hereby amended-

(a) by the substitution in subsection (1) for paragraph (a) of the definition of "holding" of the following paragraph:

"(a) land held by any person other than the State under separate grant, deed of transfer or certificate of title;"; 

(b) by the insertion in the said subsection (1) of the following paragraph after paragraph (b) of the definition of "holding":

"(bA) other land which vests in the State;";

(c) by the substitution in the said subsection (1) for the definition of ''Minister'' of the following definition: 

'' 'Minister' means the Minister of [Agncultural Technical Services] Agriculture;'';

(d) by the insertion in the said subsection (1) of the following subparagraph after subparagraph (i) of paragraph (b) of the definition of "owner":

"(iA) is land mentioned in paragraph (bA) of that definition, the State, or is such land which has been purchased by any person but which has not yet been registered in his name, that person;"; -

and 

(e) by the substitution in the said subsection (1) for subparagraph (iii) of paragraph (b) of the definition of "owner" of the following subparagraph: 

"(iii) is land referred to in paragraph (d) of that definition, the Minister of Coloured [Affairs] Relations;".

Short title.

2. This Act shall be called the Fencing Amendment Act, 1978.
