Electoral and Related Affairs Amendment Act, 1985 (No. 36 of 1985)

Act

  • to amend the Electoral Act, 1979 [repealed in January 1994], so as to limit the provisions regarding opinion polls to general elections;
  • to repeal section 35 of the General Law Amendment Act, 1972; and
  • to provide for incidental matters.

BE IT ENACTED by the State President and the Parliament of the Republic of South Africa, as follows:-

Amendment of section 143 of Act 45 of 1979.

1. Section 143 of the Electoral Act, 1979, is hereby amended by the substitution for subsection (1) of the following subsection:

"(1) No person shall in respect of an election, except any election contemplated in section 110, during the period from nomination day up to and including polling day conduct in any division an opinion poll iii respect of the support enjoyed by the several political parties taking part in that election, or by the policies which they advocate, or by the respective candidates at that election, or publish the result of such an opinion poll conducted prior to, on or subsequent to nomination day.".

Repeal of section 35 of Act 102 of 1972.

2. (1) Section 35 of the General Law Amendment Act, 1972, is hereby repealed.

(2) Subsection (1) shall be deemed to have come into operation on 3 September 1984.

Short title.

3. This Act shall be called the Electoral and Related Affairs Amendment Act, 1985.
