78 of 1989

The Companies Amendment Act 78 of 1989 intends:

  • to amend the Companies Act, 1973 [repealed in 2011], so as
  • to provide for certain fees to be prescribed by regulation;
  • to provide for the establishment of a Securities Regulation Panel;
  • to prescribe the functions and powers of the said panel;
  • to determine the administration and financing of the panel;
  • to prohibit certain dealings in securities;
  • to place an obligation on certain persons to furnish information; and
  • to further regulate and prescribe penalties for offences; and
  • to provide for matters connected therewith.

Commencement

  • 1 February 1991, Section 4(b) to the extent that it inserts 440(f) and 440(g) in Act 61 of 1973 (Gazette 12997 of 1 February 1991)
  • 26 January 1990,  (Gazette 12265 of 26 January 1990)
  • 1 October 1989, Sections 1-4(a), 5 and 4(b) to the extent that it inserts section 440B in the Companies Act 61 of 1973 (Gazette 12112 of 29 September 1989)
