Carriage by Air Amendment Act, 1964 (No. 5 of 1964)

Act

to amend the Carriage by Air Act, 1946.

(English text signed by the State President.)
(Assented to 18th February, 1964.)

Be it enacted by the State President, the Senate and the House of Assembly of the Republic of South Africa, as follows:-

Substitution of section 1 of Act 17 of 1946.

l. The following section is hereby substituted for section one of the Carriage by Air Act, 1946 (hereinafter referred to as the pnncipal Act):

"Definitions.

1. In this Act- . '
'Minister' means the Minister of Transport; "
'Republic' includes any territory in respect of which Parliament is competent to legislate."'.

Amendment of section 5 of Act 17 of 1946.

2. Section three of the principal Act is hereby amended-

(a) by the substitution in sub-section (2) for the words "Govemor-General" and "proclamation'' wherever they occur of the words "Minister" and "notice" respectively; and

(b) by the substitution in sub-section (7) for the words "Union currency" of the words "currency of the Republic.".

Amendment of section 5 of Act 17 of 1946.

3. Section five of the principal Act is hereby amended-

(a) by the substitution in sub-section (1) for the word "Governor-General" of the words "State President";

(b) by the insertion in that sub-section after the word "ratify" of the words ''or adhere or accede to" and after the word "ratified" wherever it occurs of the words "or adhered or acceded to";

(c) by the insertion after that sub-section of the following sub-section:-
"(1)bis Any proclamation under sub-section (1) may provide for such exceptions and contain such incidental or supplementary provisions as may be necessary to give due effect to the relevant amendments of or additions to the Convention or to ensure that the international obligations of the Republic will be fulfilled."; and

(d) by the insertion in sub-section (2) after the word " ratified" of the words "'adhered or acceded to" and after the word "shall" of the words "subject to any exceptions or provisions referred to in sub-section (l)bis".

Amendment of section 6 of Act 17 of 1946.

4. Section six of the principal Act is hereby amended by the substitution for the words "Govemor-General" and "proclamation" wherever they occur of the words "Minister" and "notice" respectively.

Amendment of section 7 of Act 17 of 1946.

5. Section seven of the principal Act is hereby amended by the substitution for the words "twenty-four of the Administration of Justice Act, 1912 (Act No. 27 of 1912)" of the words "forty-three of the Supreme Court Act, 1959 (Act No. 59 of 1959)'". 

Amendment of section 8 of Act 17 of 1946.

6. Section eight of the principal Act is hereby amended by the substitution for the word "Governor-General" of the word "Minister".

Substitution of "Union" in Act 17 of 1946.

7. The principal Act is hereby amended by the substitution for the word "'Union" wherever it occurs of the word "Republic".

Short title.

8. This Act shall be called the Carriage by Air Amendment Act, 1964.
