Bethelsdorp Settlement Amendment Act, 1983 (No. 49 of 1983)

Act

to amend the Bethelsdorp Settlement Act, 1921, so as to remove certain restrictions on the transfer of land at Bethelsdorp and to assign certain powers to the Minister of Community Development; and
to provide for incidental matters.

BE IT ENACTED by the State President and the House of Assembly of the Republic of South Africa, as follows:

Amendment of section 1 of Act 34 of 1921, as substituted by section 1 of Act 44 of 1966.

1. (1) Section 1 of the Bethelsdorp Settlement Act, 1921 (hereinafter referred to as the principal Act), is hereby amended by the substitution for the proviso of the following proviso:

"Provided that Clause (6) of the said resolution shall be [amended as shown in Part II of the said Schedule] deemed not to form part of that resolution, and all necessary powers and authonty are hereby conferred upon the State President for giving and enforcing full and complete effect to the terins of the said resolution as so deemed to be amended, anything to the contrary notwithstanding in any law contained.".

(2) Subsection (1) shall be deemed to have come into operation on 14 March 1979.

Amendment of section 1A of Act 34 of 1921, as inserted by section 2 of Act 44 of 1966.

2. Section 1A of the principal Act is hereby amended by the substitution for the last sentence of the clause contained therein of the following sentence:

"If the saltpan shall at any time in the future bring in more that R400 the Board shall be entitled, subject to the approval of the Minister of [Agricultural Credit and Land Tenure] Community Development or an officer in the public service authorized thereto by him, to devote such further sum either to assist the Church or the School at Bethelsdorp, or for other public purposes for the benefit of the inhabitants of Bethelsdorp.".

Insertion of section 1B in Act 34 of 1921.

3. The following section is hereby inserted in the principal Act after section 1A:

"Construction of Clause (3) of the resolution of Parliament.

1B. The reference in clause (3) of the said resolution to the Minister of Lands shall be construed as a reference to the Minister of Community Development.".

Amendment of Schedule to Act 34 of 1921, as amended by section 1 of Act 3 of 1926.

4. (1) The Schedule to the principal Act is hereby amended by the deletion of Part II.

(2) Subsection (1) shall be deemed to have come into operation on 14 March 1979.
