87 of 1989

The Attorneys Amendment Act 87 of 1989 intends:

  • to amend the Attorneys Act, 1979, so as
    • to replace the designation "articled clerk" with "candidate attorney";
    • to redefine "building society";
    • to define "trust account"; 
    • to make other provision relating to the engagement and service of candidate attorneys;
    • to further regulate the admission and readmission of attorneys and the removal of attorneys from the roll;
    • to change the name of the Attorneys, Notaries and Conveyancers Fidelity Guarantee Fund;
    • to make further provision relating to the convening of meetings of the board of control of the said fund;
    • to authorize the said board of control to appoint committees;
    • to further regulate payments from the said fund;
    • to extend the powers of the councils of law societies;
    • to further regulate the keeping of a trust account by a practising practitioner;
    • to increase various maximum fines; and
    • to rectify certain incorrect or obsolete references;
  • to amend the Magistrates' Courts Act, 1944, so as to make other provision in relation to the appearance of candidate attorneys in magistrates' courts; and
  • to provide for matters connected therewith.
