Validation of Certain By-Laws Act (House of Assembly), 1990 (No. 48 of 1990)

Act

• to provide for the validation of certain by-laws of the Provinces of the Cape of Good Hope and the Transvaal applicable within certain areas and invalid for a particular reason and
• for matters connected therewith.

BE IT ENACTED by the State President and the House of Assembly of the Republic of South Africa, as follows:-

Validation of certain by-laws (Cape)

1. As the administration of the provisions of inter alia section 190 of the Municipal Ordinance, 1974 (Ordinance No. 20 of 1974) (Cape), has, to the extent to which it is applicable within an area which has by the Declaration of Local Authorities Areas Ordinance, 1986 (Ordinance No. 18 of 1986) (Cape), been declared as a local government area for the White population group, been assigned by Proclamation No. R.37 of 1989 to the Minister of Local Government and Housing: House of Assembly, any by-law which has as from 1 April 1989 been approved by the Administrator under section 190 of the said Municipal Ordinance, 1974, and published in terms of that section and which purports to apply within an area which has by the said Declaration of Local Authorities Areas Ordinance, 1986, been declared as a local government ar~a for the White population group, but which is invalid by reason of the absence of the approval of the responsible Minister concerned, is hereby validated with effect from the date on which such by-law was published.

Validation of certain by-laws (Transvaal)

2. As the administration of the provisions of inter alia section 99 of the Local Government Ordinance, 1939 (Ordinance No. 17 of 1939) (Transvaal), has, to the extent to which it is applicable within an area which has by the Local Government Areas Ordinance, 1986 (Ordinance No. 24 of 1986) (Transvaal), been declared as a local government area for the White population group, been assigned by Proclamation No. R.36 of 1989 to the Minister of Local Government and Housing: House of Assembly, any by-law which has as from 1 April 1989 been approved by the Administrator under section 99 of the said Local Government Ordinance, 1939, and published in terms of section 101 of that Ordinance and which purports to apply within an area which has by the said Local Government Areas Ordinance, 1986, been declared as a local government area for the White population group, but which is invalid by reason of the absence of the approval of the responsible Minister concerned, is hereby validated with effect from the date on which such by-law was published.

Short title

3. This Act shall be called the Validation of Certain By-Laws Act (House of Assembly), 1990.
