Second Unemployment Insurance Amendment Act,1977 (No. 118 of 1977)
Act
- to amend the Unempioyment Insurance Act, 1966 [repealed in 2002], in order:
- to preserve the right of certain persons who were contributors immediately prior to Bophuthatswana's becoming independent, to benefits and allowances; and
- to provide for the payment of a certain amount to the Government of Bophuthatswana; and
- to provide for incidental matters.

Be it enacted by the State President, the Senate and the House of Assembly of the Repubhc of South Africa, as follows:-
Amendment of section 7 of Act 30 of 1966.
1. Section 7 of the Unemployment Insurance Act, 1966 (hereinafter referred to as the principal Act), is hereby amended by the substitution for paragraph (g) of the followingg paragraph:
" (g) the payment of any other expenditure mcurred by the Secretary in the administration, of this Act including the expenses referred to m section 49 or 64C. ".
Insertion of sections 64B and 64C in Act 30 of 1966.
2. The following sections are hereby inserted in the principal Act after section 64A:
" Preservation of certain rights after Bophuthatswana becomes independent.
64B. (1) No benefit or allowance payable to any person under Chapter VI immediately prior to the date on which Bophuthatswana becomes independent and no benefit, or allowance to which any person has become entitled under the said Chapter before that date, shall cease to be payable on or after that date by reason only that the person concerned ceased to be a contributor by virtue of Bophuthatswana's becoming independent or that Bophuthatswana no longer forms part of the Republic.
(2) Any application by a person referred to in subsection (1) for a benefit or allowance under Chapter VI shall, subject to the provisions of this section, be made to and be dealt with by a claims officer, but such application shall not be considered unless it is received by such claims officer or his represeritative, who may be an officer or employee in the public service of Bophuthatswana, before the date on which Bophuthatswana becomes independent.
Payment of amount to Bophuthatswana for purposes of establishment of unemployment insurance fund.
64C. The Secretary shall, as. soon as practicable after the date on which Bophuthatswana becomes independent, pay from the fund to the Government of Bophuthatswana an amount of three hundred thousand rand for the purpose of assisting it to establish an unemployment insurance fund for the payment of unemployment benefits in Bophuthatswana. "
Short title and commencement.
3. This Act shall be called the Second Unemployment Insurance Amendment Act, 1977, and shall come into operation on the date on which Bophuthatswana becomes independent.
