Petition Proceedings Replacement Act,1976 (No. 35 of 1976)

  • to provide for the replacement of petition proceedings in courts of law.

Be it enacted by the State President, the Senate and the House of Assembly of the Republic of South Africa, as follows:-

Construction of certain references to petition proceedings

1. As from the commencement of this Act any reference in any law to the institution of application proceedings in any courtby petition, shall be constr:ued as a reference to the institution of such proceedmgs by notice of motton In terms of the rules regulating the conduct of the proceedings of such court.

Short title and commencement.

2. This Act shall be called the Petition Proceedings Replacement Act, 1976, and shall come into operation on 1 July 1976.
