Harbour Construction Act,1972 (No. 28 of 1972)

  • to provide for the construction and equipment of a certain commercial harbour and for matters incidental thereto.

Be it enacted by the State President, the Senate and the Construction House of Assembly of the Republic of South Africa, as and equipment follows:- 

Construction and equipment of a certain commercial harbour and defrayment of cost.

1. (1) The State President may, as soon after the commencement of this Act as to him may seem expedient, cause to be constructed and equipped a commercial harbour in the area known as "Richards Bay lagoon" and on such land adjoining the said lagoon as may be required from time to time for the said harbour, in the Province of Natal.

(2) The cost of construction and equipment of the commercial harbour authorized by subsection (1) shall be defrayed out of a loan raised by the State President under the authority oflaw and appropriated for that purpose by Parliament, or out of any other moneys so appropriated.

(3) The powers conferred by this section shall include the power to construct and equip the entrance works, entrance channel and all navigational channels, turning basins, wharves, docks, basins, jetties, piers, flood control systems, tide control systems, signal stations, navigational aids, yards, railway lines, sidings, buildings and any other facilities or appurtenances or additional works necessary for or incidental to the proper working of the said harbour.

(4) The expression "construct and equip" shall include "maintain" while the harbour is in the course of being constructed and equipped.

Powers incidental to construction and equipment.

2. In respect of the construction and equipment of the said harbour, the State President shall have the powers conferred by the Railway Expropriation Act, 1955 (Act No. 37 of 1955), but subject to the obligations imposed by that Act: Provided that for the purposes of this Act, any reference in the said Railway Expropriation Act, 1955, to a "railway", shall be deemed to include a reference to the said harbour and ancillary works contemplated in section 1 (2).

Short title.

3. This Act shall be called the Harbour Construction Act, 1972.
