ISitatimende somHlangano weKhabinethi Wamhlana ama-24 kuMgwengweni wee-2015

1. Ukuphunyeleliswa Kwamahlelo Karhulumende Aqakathekileko

1.1. IKhabinethi  izithokozele iinqunto ekuvunyelenwe ngazo emHlanganweni omKhulu wama-25 weHlangano yoBunye be-Afrika ( i-AU ), yona efaka i-Afrika endleleni etja yetuthuko nokuhluma ezakwenza ukuthi i-Afrika ithathe indawayo eyifaneleko eendabeni zamazwe ngamazwe.

Hlangana neenqunto ekuvunyelenwe ngazo kubalwa nebutho lamajoni linye elihlanganeko nelisebenzako, ekufanele ukuthi kuthi kuphela umnyaka lo libe selisunguliwe. 

Abadosipbambili bathembise ukuwukhambisa msinyana umsebenzi wokwenza ukuthi likghone ukusebenza lelibutho, elibizwa ngokuthi liButho le-Afrika eleLusileko (i-ASF).

IKhabinethi ilibukile igadango elithethwe yi-AU lokuhlanganisa irhwebo lokurhwebelana kwamazwe we-Afrika nelokuvula imikhulumiswano yokuvulwa kwesiphande sokurhwebelana ngekululeko, yona ezakuqinisa ubudlelwano hlangana neminotho yamazwe we-Afrika.

1.2 IKhabinethi   ibuye yathokozela nomhlangano waboNgqongqotjhe beHlangano yoBunye be-Afrika abaPhethe iiNdaba zoBulili nezaboMma, ebewubanjwe mhlana ali-12 kuMgwengweni wee-2015, ngemva komHlangano wesiBili wesiGungu seenKhulu ze-AU ngezokuLinganiswa koBulili nokuHlonyiswa ngaMandla kwabaNtu abaSikazi (i-HLP), ebewubanjwe ukusukela mhlana ali-10 ukuyokufika nakali-12 kuMgwengweni wee-2015, ngahlanye komHlangano oJayelekileko we-AU weHlandla lama-25, ngaphasi koMmongondaba othi: “Phumelelisani Ukufakwa Nokuhlanganyela Ngokweemali Kwabantu Abasikazi Ekorweni Yezokulima Nokufuya.”
                                                                                                                              
Umphumela wemihlangano emibili le kube siVumelwano nesiBawo seGadango lokuFaka abaNtu abaSikazi kezokuLima nokuFuya. IsiBawo seGadangwesi, hlangana nokhunye, sikhombela amaZwe amaLunga ukuthi.                                                                                                                 

  • Asebenzise amalungelo wabantu abasikazi wokuthola, nokulawula,  nokuba banikazi kunye nawokuzuza emithonjeni yemali, ekubalwa hlangana nayo namahlelo wekambiso yokuthola  ekufanele bakuthole eFundweni, nekorweni yezokwazisa, yokwakhiwa nokuthuthukiswa kwamakghonofundwa, ithekhnoloji yamandla wokusungula nokwenza, ukunikela nokuthuthukisa abantu abasikazi ngamandla womnotho kezokulima nokufuya,                                                                                                                       
  • Aphakamise amagadango wokwakhela abantu abasikazi ibhoduluko kobanyana bazokukghona ukuraga umsebenzi webhizinisi yokulima nokufuya kunye nekoro yokuzuza kezokulima nokufuya ngokuphelela kwayo ngokuvikela nangokusikimela msinyana ukurarana e-Afrika, kubonisanwe, kurarululwe bekulungiswe imiraro ebangwa kutjhugulukatjhuguluka kwetlayimethi, kubonisanwe nangeendlela zokulungisa umraro obangwa zizifo ezirhatjheka indawo yoke njengomlilo obhebhedlhiswa mummoya omkhulu, bekubonisanwe nangeendlela zokulungisa umonakalo obangwa yihlekelele yemvelo.                                                                                                                        
  • Alekelele ukwakha nokuthuthukisa umsebenzi webhizinisi yokulima nokufuya kiwo woke amahlelo wokuzuza kezokulima nokufuya, ngokusebenzisa imitjhini, namandla wethekhnoloji wokusungula, kunye nokutlanywa nokuthuthukiswa kwamakghonofundwa wabantu abasikazi.                                                                                                                   

1.3 Kungasi ziinyanga ezingaki ukusukela gadesi, abafundi bakwaMethriki bazabe bathoma ukutlola iinhlahlubo zabo zokuphela komnyaka. IKhabinethi ibawa abafundi bakaMethrikhi bomnyaka wee-2015 ukuthi bathome kusese nesikhathi ukwenza iimbawo zokuyokufunda emazikweni wefundo ephakemeko, njengengcenye yeJima i-Apply Now/Khetha Career Guidance, eliragwa mNyango wezeFundo ePhakemeko nokuBandula qobe mnyaka.                                                                                                                                                 

Sikhwezelela abafundi ukuthi bacabangele nokuthatha iimfundo ze-Methemethiksi neSayensi njengeemfundo ezingaphakamisa umnotho wekhethu ukuya phambili. Amandla wokusungula newokutlama mamandla ayisika yokuthuthukisa umnotho welizwe. Abantu abatjha abalinge namathuba akhona emaKholeji wokuFundela umSebenzi agcwele ilizwe lokeli, ngaphandle kwamayunivesithi, ekubalwa hlangana nawo namayunivesithi amatjha asandukuvulwa, iYunesivithi yeMpumalanga kunye neYunivesithi iSol Plaatjie eseTlhagwini Kapa.  

2. IinQunto zeKhabinethi eziQakathekileko

2.1 IKhabinethi isifakazele yasiqinisa isiqunto sokujamisaisiZinda sokuThuthukiswa kwamaBubulo iMaluti-A-Phofung (i-MAP IDZ)   e-Tshiame (i-Industriqwa-1A), e-Harrismith, esiFundeni seFreyistata. Ibuye yavumela nokunikelwa kweHlangano eThuthukisa amaBubulo yeFreyistata iMvumo yokuSebenzisa lendawo. Ukuthiywa kwe-MAP IDZ njengesiZinda sokuThuthukisa amaBubulo kuzokuvula ikundla yeentlabagelo zeensetjenziswa (i-Logistics Hub) ebangeni elimakhilomitha alitjhumi ngaphandle kwe-Harrismith (indawo endala ye-Industriqwa); umnqopho wokuthoma wendawo le kusebenzela okusebenza ngemitjhini, amafemu akhanda izinto ezilula, amafemu asebenza ipahla ephathelene nezokulima kunye naphathelene nokusabalalisa ipahla namkha amakoro weentlabagelo zeensetjenziswa. 

2.2 IKhabinethi ivumele ukuthi i-Afrika ijoyine iBhanka ye-Asia yezokusisisa ngezomThangalasisekelo. IBhanka le iqalene nokusekela amasiso womthangalasisekelo esiPhandeni se-Asia nese-Oceania.

Ukuhlanganyelwa kweSewula Afrika kuzakuqinisa ubudlelwano bayo bamabhizinisi nalesisiphande, esele vele besele buthomile ukuqina, kanti kuzakubuye godu kutjengise ukuzwelana netjisakalo yetuthuko yakilesisiphande.

2.3 IKhabinethi ivumelene nokunikelwa kwakaNgqongqotjhe wezoBulungiswa nezokuVuselelwa kweeMilo kunye nowezamaPholisa umsebenzi wokulekelela umBuso ukuphumelelisa umThetho womnyaka wee-2013 wokuVikela nokuCitha umuKghwa wokuKhahlunyezwa kwabaNtu, ngokwendinyana 9(2).

Bobabili abongqongqotjhaba bazakuthwala umsebenzi wokutlama amahlelo anqophe ukukhandela nokucitha ukukhahlunyezwa kwabantu, njengendlela yokuphakamisa nokukhuthaza ilungelo lekululeko nelokuphepha komuntu, njengoba kusitjho indinyana ye-12 yomThethosisekelo.

2.4   IKhabinethi ivumele ukudluliselwa ePalamende kwesiphakamiso seKambisolawulo eNgezelelweko yesiVumelwano seRhwebo, seTuthuko nokuSebenzisana hlangana komPhakathi weYorobhu namaZwe amaLunga wayo kobanyana iPalamende iyosifakazela.

IKambisolawulo eNgezelelweko le iqalelela   ukungena kweRiphabhligi ye-Croatia eHlanganweni yoBunye beYurobhu (i-EU), engena ngemva kwesikhathi kileKambisolawulo.

Ukukhuliswa kwe-EU kuzawenza abe ngcono amathuba wokutholakala kwemakethe yeSewula Afrika ku-EU, lokho bese kuvula amathuba wemisebenzi, kuqinise namathuba wokuhluma komnotho, ngaleyindlela abe ngcono namathuba wokuzikhethela kwabathengi. Lokhu-ke kukhambisana nenembombono yomTlamo wezokuThuthukiswa kweliZweloke (i-NDP)   enqophe ukuvula imisebenzi, nokuhlumisa umnotho kunye nokukhuthaza ukuthengisela amazwe wangaphandle.
                                                                                                                       
2.5  IKhabinethi ivumele ukuthi kusetjenziswe amazinga afaneleko wamazwe ngamazwe nezinye iindlela zesayensi, kobanyana kuzokuba nesiqinisekiso sokuthi ilawuleka ngokwaneleko ingozi engaba khona lokhuya nakuthengwa emazweni wangaphandle inyama yekomo neminye imikhiqizo yekomo egonywako.

Lokhu kuthomanisa iSewula Afrika nokuthenga emazweni wangaphandle nekombandlela yesayensi yamazwe ngamazwe kuzakuqinisa ubujamo belizwe lekhethweli erhwebeni lamazwe ngamazwe. Lokhu-ke kuzakunabisa amathuba wokufumana ukugoma okwaneleko, okuphephileko, nokunepilo okuzakugonywa babantu neenyamazana ngeendlela ezihlelwe kuhle, kwandise namathuba wokuvulwa kwemisebenzi ngokuthengwa kwenyama yekomo neminye imikhiqizo yekomo esafanele bona isetjenzwe ukuya phambili nayifika lapha eSewula Afrika ngaphambi kobana ingagonywa.

3 Imithethomlingwa

3.1 IKhabinethi ivumele ukuthonywa ePalamende komThethomlingwa oTjhugulula umThetho wezobuLelesi, womnyaka wee-2015.

Amatjhuguluko womthethomlingwa la aqalelela imithetho ephathelene namacala wezomthangalasiseleko, amacala anjengokwetjiwa kwamakheyibuli newokwetjiwa kweendrada zefowuni.

NgomThethomlingwa omutjha lo, sizokuqiniswa khudlwana isandla semibandela yokubheyiliswa, neyokugwetjwa kweenlelesi ezilahlwe macala, bekuvulwe namacala amatjha azakwenza kube licala ukona umthangalasisekelo oqakathekileko owonakele ngenca yokuphinigana namkha ukuliya ukusebenza kwezenzelwa ekuphilwa ngazo.

UmThethomlingwa lo nasele uphasisiwe waba mThetho, uzakwenza isiqiniseko sokuthi kuba neendlela zokuphephisa umthangalasisekelo, la kufuneka khona khulu khulu ukuthi umphakathi ube nerhuluphelo netjisakalo yokuwubabalela umthangalasisekelo, kobanyana ilizwe lekhethu lizokuphumelela ukufika emnqopheni oqothelweko wokuhlumisa umnotho newokwandiswa kwemisebenzi.                                                                                                                                  
3.2   IKhabinethi ivumele ukwethulwa ePalamende komThethomlingwa oBuyekeziweko wezokuKhuthaza nokuVikelwa kwamaSiso, womnyaka wee-2015.                                                                                                                                       
UmThethomlingwa lo ufakaza ngobutjha ukuthi iSewula Afrika isawamukela amasiso wamazwe wangaphandle, isabavikela ngokupheleleko boke abasisi, kanti injalo nje inelungelo lokuzijamela likaRhulumende weSewula Afrika lokulandelela iminqopho yezetuthuko neyokwenza amatjhuguluko.                                                                                                                                             
Lokhu-ke kukusekela umnqopho we-NDP wokukhuthaza ukuhluma kwamasiso nomsebenzi wokuthengisela amazwe wangaphandle kobanyana kuzokusekeleka ukuhluma netuthuko ebambelelako eSewula Afrika.
3.3 IKhabinethi ivumele ukumenyezelwa eGazedeni yomBuso komThethomlingwa oTjhugulula umThetho woBunikazimtlolo, womnyaka wee-2015, kobanyana kuzokwanda abantu ekubonisanwa nabo ngawo.                                                                                                                                  
UmThethomlingwa lo utjhugulula umThetho Nomboro 98 womnyaka we-1978, woBunikazimtlolo, nomThetho Nomboro 11 womnyaka we-1967, oVikela abaDlali beKundleni, ngoba sewuphelelwe sikhathi njengoba ungaqaleleli okwenzeka emikhakheni elakanyeneko, begodu unganakho nalapho ukhuluma khona ngeendaba zehlelo lokusabalalisa ilwazi ngendlela ebudijithali.                                                                                                                                        
UmThethomlingwa lo ukhuluma nangokutholakala kwelayisense yomsebenzi wobunikazimtlolo, malungana nomsebenzi othunyiweko, ukuvimbela ukuqhatjhazwa kwabantu kezeemali. Lokhu-ke kuzakulekelela urhulumende ukuthi akghone ukulungisa umraro womtlhago abavumi nabadlali besiteyiji namkha bekundleni abazithola bakiwo; lokho-ke kuzakwenziwa ngokuthi kwenziwe isiqinisekiso sokuthi iinkampani ezirekhodisa abavumi nabadlali besiteyiji namkha bekundleni kunye neenhlangano ezirhatjhako zibabhadela ngesikhathi abavumi nabadlali besiteyiji, njengombana sekubonakele nje ukuthi ubunengi babo babhubha banganalitho.  
                                                                                                                                                              
3.4 IKhabinethi ivumele ukwethulwa ePalamende komThethomlingwa wokuTjhugulula umThetho wee-2015 oLawula iKomitjhini yeenSebenzi zemBusweni. Lo-ke utjhugulula umThetho Nomboro 46 womnyaka we-1997, weKomitjhini yeenSebenzi zemBusweni.

UmThethomlingwa lo uphathelene nokuvuselelwa kwesikhathi sokusebenza sikaKomitjhinari oPhethe iKomitjhini, kanti godu unikela noSihlalo amandla wokukhetha omunye wabokomitjhinari ukuthi aje abambele uSihlalo, nakube uSihlalo neSekela lakhe bobabili abakho.    
                                                                                                                                      
4. UbuJamo beKhabinethi Ngeendaba ezeNzeka esiKhathini Sanje

4.1 IKhabinethi iyazamukela izakhamuzi ze-Cuba eziHlanu (i-Cuban Five) ezabotjhwa e-USA ngomnyaka we-1998, zagwetjwa ngamacala wobuhloli newokubulala. Ama-Cuba amaHlanu ayethunyelwe e-USA njengengcenye yethungelelwano elibizwa ngokuthi yi-La Red Avispa, kobanyana ayokuphenya ngemisebenzi yezakhamuzi ze-Cuba ezazisekudingisweni ezarerela ukuketula umbuso ka-Fidel Castro.

4.2 IKhabinethi ithokoza urhulumende we-Malawi, ngokujanyelwa siKhulu sabaZenda eSewula Afrika uMma u-Cassandra Mbuyane-Mokone ngokuphumelelisa kwakhe ukubuyiswa kwabantwana beSewula Afrika ababili omunye wabo oneminyaka eli-14 bese kuthi omunye abe nema-20, abahlukaniswa nogogwabo owayebondla eMpumalanga, basiwa eMalawi ngoVelabahlinze womnyaka wee-2014, bathathwa ngumma othileko owazenza umuntu owakhe waba ngutitjhere. Namhlanjesi-ke uNgqongqotjhe wezokuThuthukiswa komPhakathi uBathabile Dlamini uzokwamukela abantwanaba.      
                                                                                                                             
5 Iminyanya Ezako

5.1  IKhabinethi imema woke amaSewula Afrika ukuthi ahlanganyele ekuthokozeleni inyanga ezokuthwasa le, uVelabahlinze njengeNyanga ka-Nelson Mandela, ngaphasi kommongondaba othi: “Yenza Elinye Nelinye iLanga Libe liLanga likaMandela: Asinikeleni ngemizuzu ema-67 yesikhathi sethu ukulekelela labo abadingileko.” 

Omunye nomunye umSewula Afrika unawo amandla wokukhulisa nokwandisa ilifa esalitjhiyelwa nguMengameli ongasekho u-Nelson Mandela, ngokwenza umehluko epilweni yabanye abantu.

Ngommoya welifa likaMadiba, asisebenzisaneni njengoba sihlonipha iNyanga yokuSebenzisana ngokuZwana ngoVelabahlinze kobanyana sizokwakha umphakathi osebenzisana ngokuzwana ngokukhuthaza iminqopho yokungabandlululani, yokungakhethi ngobulili, yokuphakamisa ubulungiswa nokulingana kibo boke abantu njengoba kusitjho umThethosisekelo wekhethu.

5.2  Njengengcenye yokuthokozela nokuhlonipha isayensi, ubunjiniyera, ithekhnoloji kunye nekghono lokusungula, uNgqongqotjhe wezeSayensi neThekhnoloji u-Naledi Pandor uzokubiza umnyanya wesidlo santambama la azokumemezela khona abafundi abaphume phambili ephaliswaneni leSayensi neThekhnoloji i-BHP Billiton Awards  mhlana ali-9 kuVelabahlinze wee-2015 e-Emperors Palace, e-Kempton Park, ngaphasi kommongondaba othi : “Umkhanyo”.

Abonongorwanaba bathoma ngomnyaka we-1988. Njengoba kuzabe kuthokozelwa ummongondaba we-UNESCO othi “Umnyaka wamazwe ngamazwe womkhanyo nethekhnoloji yomkhanyo,” uNongorwana oKhethekileko uzokunikelwa irhubhululo eliphathelene nokusetjenziswa komkhanyo ukukhambisa imininingwana yelwazi, iFothoniks.

5.3  Ngommoya weVeke  yeenSebenzi zemBusweni ze-Afrika ekiliveke (ukusukela mhlana ama-22 ukuyokufika mhlana ama-26 kuMgwengweni wee-2015,) iKhabinethi izakuthanda ukuthokoza zoke iinsebenzi zembusweni ngokuzibophelela kwazo, nangokuncama kwazo, nangokukhuthala kwazo ekusebenzeleni abantu bekhethu. Sikhombela zoke iinsebenzi zembusweni ukuthi zizibophelele ngobutjha ukugcina iimfanelo zawo woke amaSewula Afrika.

6. Ubujamo beSewula Afrika Ngendaba yeKhotho yezobuLelesi bamaZwe ngamaZwe (i-ICC)

IKhabinethi iqunte ukuthi kungcono ukuthi ikubuyekeze ukuhlanganyela kwayo namanye amazwe esiVumelwaneni somLayelo weRoma se-ICC; zimbadlwana-ke iinzathu zeSewula Afrika zokucabanga ukuhlubuka kilesisivumelwano.

Soke isikhathesi iSewula Afrika beyimsekeli omkhulu wegadango lokusungulwa kwe-ICC. Nanje solo isazibophelele ehlelweni lobulungiswa bamazwe ngamazwe “ukuqinisekisa ukuthi amacala wobulelesi amambi kinawo woke emazweni ngamazwe ngokuphelela kwawo akukafaneli ukuthi aphunyurhe angajeziswa, nokuthi nokutjhutjhiswa kwawo ngepumelelo kufanele kuqinisekiswe ngokuthathelwa amagadango elizweni loke nangokukhuphula isebenziswano lamazwe ngamazwe.” 

ISewula Afrika izakusolo ikhuthaza beyikhwezelela amagadango wamazwe we-Afrika newephasi loke wokulwa namacala anje.

ISewula Afrika ililunga leBandla lemiBuso (i-Assembly of States Parties) elasungulwa ngendinyana 112 (1) yesiVumelwano somLayelo weRoma we-ICC.

ISewula Afrika godu ililunga leHlangano yeenTjhaba eziBumbeneko (i-UN), nelunga leHlangano yoBunye be-Afrika, nezinye iinhlangano zamazwe ngamazwe. Izithathela phezulu khulu iimbopho zayo zamazwe ngamazwe.

ISewula Afrika yenza umsebenzi oqakatheke khulu e-Afrika kunye nakezinye iinhlangano ezihlukahlukileko ze-Afrika. Godu ililizwe la kubanjelwa khona iPalamende yamaZwe we-Afrika (i-PAP). UNgqongqotjhe wangaphambilini  wezangeKhaya eSewula Afrika nguye uSihlalo weKomitjhini yeHlangano yoBunye be-Afrika.

ISewula Afrika inesandla eenqhemeni zokuncengelela ukuthula emazweni we-Afrika amanengi, njenge-Democratic Republic of the Congo. ISewula Afrika godu inesandla emsebenzini wokuqinisekisa ukuthi liyaphumelela ihlelo lokuthula elibuthakathaka eSudan neSewula Sudan, kobanyana kuzokusizakala abantu balemibuso ezijameleko neminye imibuso yamazwe azijameleko kunye ne-Afrika yoke. 

ISewula Afrika ephasini loke ithathwa njengomlamuli nomncengeleli wokuthula othembekileko, ngamajoni alinganiselwa eenkulungwaneni ezintathu alekelela kilamajima wokuthula ngaphasi kwe-AU ne-UN.                                                                                                                              

ISewula Afrika ikhuthazela ukusebenza ngokulekelelana hlangana kwayo namanye amazwe netuthuko elungelelweko e-Afrika yoke. ISewula Afrika isebenzisa isiKhwama sokuVuselelwa kwe-Afrika nesokuSebenzisana namaZwe ngamaZwe, hlangana nokhunye, ukuphakamisa ihlelo lokubusa ngentando yenengi, ikambiso ehle yokubusa kunye nokuvimbela ukurarulula irarano.
                                                                                                                                 
ISewula Afrika isisisa khulu eemalini zayo, kezobujoni, nemithonjeni yezechwephetjhe kunye neyamandla wabantu, ngomnqopho wokuletha ukuthula, ukuphepha netuthuko e-Afrika. Ubuhle bamasiso la kancani kancani sebuthoma ukubonakala emazweni la iSewula Afrika inelitho elenzako khona. Hlangana namazwe lawo kubalwa ne-Sudan kunye ne-South Sudan.

Nanyana ililunga leBandla lemiBuso elatlikitla isiVumelwano somLayelo weRoma se-ICC, iSewula Afrika kufanele ilinganise iimbopho zayo ku-ICC neembopho zayo ku-AU, neembopho zayo elizweni ngalinye, sekubalwa namazwe we-Afrika, malungana neemvumelwano eyazitlikitla namazwe ngamazwe.                                                                                                                               

ISewula Afrika itjheja iyayelela ukuthi ngitjho namaLunga kaNomphela womKhandlu wezokuVikela we-UN angazange asitlikitla isiVumelwano somLayelo weRoma nge-ICC, kodwana nawo angaba nelizwi ngokupheleleko emacocweni nge-ICC nangokuthunyelwa ku-ICC mKhandlu wezokuVikela ngobujamo bezinto elizweni elithileko.

Amazwe lawo athethe amagadango wokuqinisekisa ukuthi iimphathimandla zawo neemphathimandla zamajoni wazo azizukuba ngaphasi  kwelawulo le-ICC.

ISewula Afrika godu iyelela beyitjheja nokuphambana namkha ukuphikisana kweendinyana ezithileko zesiVumelwano somLayelo weRoma se-ICC malungana nokuvikeleka kweenKhulu zomBuso.

2.  Ubuphephelo namkha imithetho ekhethekileko yekambiso engakhambisana nesikhundla esiphethwe mumuntu, ngaphasi komthetho welizwe namkha ngaphasi komthetho wamazwe ngamazwe, angeze buvimbele iKhotho le ukuthi isebenzise amandlayo phezu komuntu onjalo.                                                                                                                       

Ngerhedlulo lokuthoma, i-Athikili le inikela i-ICC amandla phezu kwananyana ngubani, ngaphandle kokuqala ukuthi umuntu loyo uyini ngokomthetho.

Nokho-ke i-Athikili yama-98 itjho nakhu okulandelako:
    
Ukusebenzisana malungana nokulahla ilungelo lokuvikeleka nokuvuma ukuzinikela.                                                                                                                         
1.  IKhotho angeze yaphikelela ngesibawo sokuthi umuntu akazinikele namkha itjhotjholozele ukulekelelwa okungafuna ukuthi umBuso okhonjelwako wenze okuphambana neembopho zawo ngaphasi komthetho wamazwe ngamazwe malungana nokuvikeleka komBuso namkha kwabazenda namkha kwepahla yomunye umBuso, ngaphandle kobana iKhotho ithome ngokuthola ukusebenzisana ngokuzwana nomBuso loyo ngokulahlwa kwelungelo lokuvikeleka.                                                                                                                    

2.   IKhotho ayikwazi ukuphikelela ngesibawo sokuthi umuntu akazinikele okungafuna umBuso okhonjelwako ukuthi wenze okuphambana neembopho zawo ngaphasi kweemvumelwano zamazwe ngamazwe la kufuneka khona ukuthi umBuso othumelako unikele umuntu othileko womBuso loyo eKhotho le, ngaphandle kobanyana iKhotho le ngokwayo ingathoma ngokuthola ukusebenzisana ngokuzwana nomBuso othumelako ngokuvuma ukuthi umuntu loyo azinikele namkha anikelwe ezandleni zeKhotho.

I-Athikili 98(2) iqakathekile begodu izwakala ngaphandle kokuzaza kekutjhoko. Itjho kuzwakale ukuthi i-ICC ayinalungelo lokukhombela ukuthi umuntu othileko anikelwe ezandleni zayo mBuso othileko, nakube lokho kuzakwenza ukuthi umbuso okhonjelwe ukunikela umuntu loyo wephule iimbopho zawo zamazwe ngamazwe, ngaphandle-ke kobana i-ICC ngokwayo ingathoma ngokuthola ibambiswano lokusebenzisana nomBuso othumelako. Ngamanye amagama, i-Athikili 98(2) ibeka ubugobe phezu kwe-ICC ukuthi yelekelele amazwe ukuphumelelisa amadarhifari wokubotjhwa kwalabo ekufanele babotjhwe.  
                                                                                                                         
Kukhanya kuhle ngokusetjhatjhalazini ukuthi i-ICC beyazi kuhle ukuthi iSewula Afrika beyingahle ibe nobunzima ekuphumeleliseni idarhifari yokubotjhwa kukaMengameli Omar Al-Bashir, ngenca yeembopho zayo (iSewula Afrika) zamazwe ngamazwe.

Mhlana ama-28 kuMrhayili wee-2015, i-ICC yasele vele imeme iSewula Afrika ukuthi ibambe imikhulumiswano nayo malungana nokuphunyeleliswa kwedarhifari yokubotjhwa kukaMengameli Al-Bashir, ngokwe-Athikili 97, yona etjho ngaphandle kokurhiniza ukuthi la umBuso uthola khona isibawo osibona inga sizawubangela imiraro engahle iliye namkha ivimbele ukuphunyeleliswa kwesibaweso, umBuso loyo kufanele bona ubonisane ne-ICC ngaphandle kokuriyada, kobanyana kuzokurarululwa indaba leyo.

Imiraro enjalo ingatjho nokuthi ukuphunyeleliswa kwesibaweso ngendlela singayo ngesikhatheso kuzakufuna ukuthi umBuso okhonjelweko wephule isibopho sawo sesivumelwano ebesele sivele sesikhona, esenziwa nomunye umBuso. 

I-ICC kufanele ukuthi beyilimuka ukuthi iSewula Afrika nayiphumelelisa idarhifari yokubotjhwa kukaMengameli u-Al-Bashir beyizabe yephula neembopho zesivumelwano enaso ne-AU.  Lokhu-ke kutjho ukuthi leso kungaba kuphela kwesizathu esenze i-ICC imeme iSewula Afrika ukuthi ibonisane nayo ngendaba le.

Emveni kobana imeme iSewula Afrika ukuthi ibonisane nayo, i-ICC ibe nesibopho sokuyibamba ngokuthembeka imikhulumiswano yokubonisana neSewula Afrika, ibe iyilekelele ukuthi ihloniphe iimbopho enazo phezu kwe-ICC ne-AU.                                                                                                                      

ISewula Afrika ivume isimemo se-ICC sokubonisana nayo ngokwemibandela ye-Athikili yama-97. Eqinisweni, iSewula Afrika ibe nokurhonona ngezinto ezimbadlwana ngokufaneleka nokulunga kokuphunyeleliswa kwamadarhifari wokubotjhwa kwaka-Al-Bashir kunye neembopho zeSewula Afrika zamazwe ngamazwe ezisukela ebulungeni bayo ku-AU.

ISewula Afrika inesibopho sokusebenzisa isiqunto esathathwa yi-AU e-Sirte, ese-Libya mhlana ama-3 kuVelabahlinze wee-2009, isiqunto esithi amalunga we-AU akukafaneli ukuthi alalele abe asebenzisane ne-ICC ngokwemibandela ye-Athikili yama-98 yesiVumelwano somLayelo weRoma se-ICC, ngaphambi kobana i-AU seyisiqalile yasihlola isibaweso.

I-AU ikhombele umKhandlu wezokuVikela ukuthi usamukele isiqunto sayo sokuthi indaba yobujamo bezinto e-Darfur idluliselwe ku-ICC kobanyana iyokuphenywa khona. 

Isibaweso-ke asikabukwenziwa. I-AU yenza isibaweso ngokwe-Athikili ye-16 yesiVumelwano somLayelo weRoma we-ICC, njengoba i-AU ikholwa ukuthi ukuba nesandla kwe-ICC endabeni le kuzakuba nengozi ekuthuleni nekuvikelekeni kwelizwekazi le-Afrika.                                                                                                                            

ISewula Afrika inerhuluphelo elithileko esiquntweni se-AU, ngenca yokuba nesandla kweSewula Afrika ehlelweni lokuncengelela ukuthula e-Sudan ne-South Sudan. Womabili amazwe la athembise iSewula Afrika iinthembiso ezimbadlwana malungana nalo ihlelo lezokuthuleli.

Nayibe ihlelo lokuthuleli liyafadalala, uzakuba mumbi okumatlhuwo umphumela walokho phezu kwabantu bamazwe amabili la naphezu kwe-Afrika yoke.

ISewula Afrika inande ibamba imikhulumiswano ne-Sudan ne-South Sudan, begodu inikelwe isiqiniseko ngiwo womabili amazwe la ngehlelo lokuthula. 

ISewula Afrika isivume ngokuthembeka isimemo se-ICC sokubonisana nayo ngokwe-Athikili yama-97, yaba nethemba lokuthi imikhulumiswano leyo izakuba ngeyakhako, ibe nemiphumela emihle ngobudisi iSewula Afrika ehlangabezana nabo ekuphumeleliseni idarhifari yokubotjhwa kwakaMengameli Al-Bashir.  

Umhlangano wokuthoma wabanjwa ne-ICC mhlana ali-12 kuMgwengweni wee-2015. Emhlanganweni loyo kwakukhona umZenda weSewula Afrika negcwetha lakhe. Kiloyomhlangano, umZenda wakhuluma wagandelela ukuthi akakghoni ukusebenza ngeendaba zomthetho ekukhulunywa ngazo, ngaleyindlela-ke wayefuna ukubiza omunye umhlangano la kwakuzakuba khona nabantu abazakukghona ukusebenza ngaleziindaba athi akakghoni ukusebenza ngazo. 

Umhlangano wesibili, wokuqalana naleziindaba, wabekelwa ilanga langoMvulo, mhlana ali-15 kuMgwengweni wee-2015. Mzukwanokho-ke kwakufanele bona kube mhlangano wamambala wokubonisana, ngokwe-Athikili yama-97.  Nokho-ke i-ICC yabiza umhlangano wangaphambi kwaloyo wangoMvulo; lo owabizwa ngaphambi kwesikhathi wabizelwa ukubanjwa ngoSondarha mhlana ali-14 kuMgwengweni wee-2015, ngo-12:30. Nokho-ke kuthe ebusuku bangoMgqibelo wamhlana ali-13 kuMgwengweni wee-2015, umTjhutjhisi we-ICC wenza isibawo esirhabako ku-ICC, ngemibandela elandelako nasi: 
“Isibawo esirhabako soMtjhutjhisi somLayelo ohlathulula ukuthi kghani iphelile na imikhulumiswano neSewula Afrika ngokwe-Athikili yama-97, nokuthi iSewula Afrika inesibopho sokuthi ibophe u-Omar Al-Bashir beyimnikele ezandleni zeKhotho khona nje.” 

UMtjhutjhisi wathumelela i-ICC lesisiBawo esiRhabako, ngaphandle kokwazisa nokunothisa iSewula Afrika. UMtjhutjhisi wakhombela ukuthi ihlale iyintumba imininingwana yalesisiBawo, kodwana isiqunto se-ICC sona simenyezelwe tjhatjhalazi.

I-ICC yalalela indaba leyo khonokho, yabe yakhupha nesiQunto sayo. Eqinisweni, i-ICC, ngaphandle kokuzwa iSewula Afrika, yaziquntela iyodwa ukuthi imikhulumiswano ye-Athikili 97 seyiphelile, yazithathela iyodwa nesiqunto sokuthi iSewula Afrika inesibopho sokubopha nokunikela uMengameli Al-Bashir ezandleni zayo.  Njengoba siqeda ukutjho, lesosiqunto senziwa ngaphandle kobanyana iSewula Afrika yaziswe ngalokho. 

ISewula Afrika, njengomBuso oliLunga lesiVumelwano somLayelo weRoma we-ICC, nanjengeLunga lesiGungu semiBuso, beyinelungelo lokwaziswa ngesiBawo esiRhabako soMtjhutjhisi esathunyelelwa i-ICC, ngaleyindlela nayo inikelwe ithuba lokuziphendulela, izwakalise layo ilizwi ngendaba le, khulu khulu njengoba vele asele enziwe amalungiselelo wemihlangano yokubonisana ngalokhu. 

Ilungelo lokuzijamela kweSewula Afrika njengomBuso oziphetheko litjho nokuthi nayo inelungelo lokuphathwa ngehlonipho ngendlela efanako nekuphathwa ngayo amanye amazwe azijameleko, ngaphandle kokukhetha ukuthi buyini, bunjani ubujamo bezinto ngalokho okwenzekako ngesikhatheso. 

Kubonakala ungathi i-ICC azange ithumelele iSewula Afrika isimemo sokubonisana nayo ngokwemibandela ye-Athikili yama-97 ngokwethembeka nangommoya omuhle wokulekelela iSewula Afrika. Ngalokho-ke iSewula Afrika iqunte ukukubuyekeza, ikuqale ngelinye ilihlo ukuba kwayo lilunga lesiVumelwano somLayelo we-ICC.

Ama-Athikili amabili wesiVumelwano somLayelo aqakathekile ukucabangela ubujamo iSewula Afrika ekufanele ibuthathe malungana nokusebenzisana kwayo ne-ICC ngomuso.  Lawo-ke ma-Athikili le-119 nele-127.

IBandla lesiGungu lingalinga lona ngokwalo ukulamula umbango loyo namkha lenze iimphakamiso ngeendlela ezingalandelwa ukulamula umbango loyo, ekubalwa hlangana nazo nokudluliselwa eKhotho yezoBulungiswa yamaZwe ngamaZwe, ngokukhambisana nemibandela nemiLayelo yeKhotho leyo.                                                         .

I-Athikili ye-119 iqalene namahlandla amabili wobujamo bezinto:                        

Kokuthoma, imibango ephathelene nemithetho yemisebenzi ye-ICC; kwesibili, nanyana ngiwuphi umbango ohlangana kwamaZwe amabili amaLunga we-ICC, ophathelene nehlathululo namkha ophathelene nokusetjenziswa kwesiVumelwano somLayelo weRoma.

Malungana nobujamo bokuthoma ngehla, iSewula Afrika ingaba nombango ne-ICC malungana nesiQunto eyasenzako ngesiBawo esiRhabako soMtjhutjhisi somLayelo ohlathulula ukuthi kghani imikhulumiswano yobunonisana neSewula Afrika ngokwe-Athikili yama-97 seyiphelile na, nokuthi iSewula Afrika inesiBopho sokuthi ibophe uMengameli Omar Al-Bashir ibe imnikele ezandleni ze-ICC.                                                                                    

ISewula Afrika izakubamba imikhulumiswano ehlelekileko ne-ICC ngendaba le, ngomnqopho wokutholisisa indlela i-ICC eyenza ngayo izinto, nanokuthola ukuthi yona iyizwa njani ihlathululo ye-Athikili yama-97. 

ISewula Afrika ifuna nokuzwisisa kuhle, ku-ICC, ukuthi yini iimbopho zayo ngokwemibandela ye-Athikili 98(2) emBusweni okhonjelweko, ongeze uphambane nesibopho sawo samazwe ngamazwe sokuphumelelisa idarhifari yokubotjhwa komuntu ekufanele abotjhwe.

ISewula Afrika ifuna godu nokuvusa indaba le emhlanganweni olandelako weBandla lesiGungu samaZwe amaLunga wesiVumelwano somLayelo weRoma we-ICC. Njengoba indaba le inoburhiyarhiya kangaka nje phezu kweSewula Afrika, iSewula Afrika izakhe icabange nangokuthi kghani indaba le ingayidlulisela eKhotho yezoBulungiswa yamaZwe ngamaZwe kobanyana iyokuzwa yona ukuthi ithini ngendaba le.                                                                                                                     

I-Athikili yama-97 azange kheyisetjenziswe yi-ICC phambilini. Leli bekulihlandla lokuthoma lokuthi i-ICC imeme iLunga leBandla lesiGungu ukuzokubonisana nalo malungana nobudisi enabo ngokuphumelelisa idarhifari yokubotjhwa komuntu, okungahle kubangele ukuthi iLunga leBandla lesiGungu lephule isibopho salo samazwe ngamazwe. I-ICC bekufanele iyithathele phezulu indaba le, kanti-ke zombili iinqhemezi, i-ICC neSewula Afrika, bezikatelelekile ukuthi zikhulumisane ngommoya wokuthembeka. 

ISewula Afrika, njengegadango lokugcina lokuzilamulela, ingahle icabange ukuphuma ku-ICC.

Isiqunto esinjalo-ke nokho sizakuthathwa nakube iSewula Afrika seyilinge zoke iindlela ezikhona zokulungisa indaba le ngokwesiVumelwano somLayelo weRoma we-ICC, nomTlolo we-UN nezinye iinsetjenziswa zomthetho wamazwe ngamazwe. 

I-Athikili ye-127 ikhuluma ngokuphuma ku-ICC, kanti itjho lokhu okulandelako, hlangana nokhunye:                                                                                                                          

1.  ILunga elimBuso lingenza isaziso esitloliweko esiqaliswe kuNobhalaZombelele weHlangano yeenTjhaba eziBumbeneko, sokuphuma kilesisiVumelwano somLayelo weRoma. Sele iLungelo litlolile lazisa ngokuphuma kwalo esiVumelwaneni, kuzakuthatha umnyaka woke ngaphambi kobana iLungelo likhutjhwe ebulungwini besiVumelwano, ngaphandle-ke kokuthi isaziso sokuphuma esiVumelwaneni sibeke esinye isikhathi esingaphezulu komnyaka.                                                                                                                    
               
ISewula Afrika izokuthoma khona nje ukukhulumisana ne-AU ) namazwe amalunga wayo, kubonisanwe ngokuthi iindlela zokulamula imibango yamazwe we-Afrika zingasetjenziswa njani ngaphandle kokuriyada, “ngomnqopho wokuqinisekisa ukuthi amacala amambi khulu emazweni ngamazwe awaphunyurhi angakajeziswa, nokuthi ukutjhutjhiswa kwawo okuphumelelako kufanele kuqinisekiswe ngokuthatha amagadango elizweni loke nangokukhuphula izinga lokusebenzisana ngokulekelelana namazwe ngamazwe.”

ISewula Afrika izakubamba imikhulumiswana nelizwe ngalinye  kewe-Afrika, ibambe imikhulumiswano namazwe we-Afrika ambadlwana kobanyana azokukhanjsiwa msinyana amatjhuguluko weKhotho yamaLungelo wobuNtu e-Afrika namanye amabandla wesiphande.  Lokhu-ke kuzakwenza isiqiniseko sokuthi amacala wobulelesi amambi khulu phezu kwabantu asetjenzwa msinyana ngileziinjamiso, bekube nesiqiniseko sokuthi kuba namahlelo wokungezelela la amacala anje atjhutjhiswa khona yi-ICC namkha atjhutjhiswe ngezinye iinjamiso ze-Afrika. 

Kungasikade, iSewula Afrika izokuhlelela ukubamba imikhulumiswana ne-ICC ngeendaba ezinomnako ngazo.

ISewula Afrika izakulungisa umbiko wayo ngokusebenzisana ne-ICC ngokwemibandela ye-Athikili yama-97 nangobunye ubudisi edlule kibo ngokwemibandela ye-Athikili 98(2), bese umbiko loyo iwudlulisela eBandleni lesiGungu emhlanganweni ozako. 

ISewula Afrika izakubuye iphakamise amatjhuguluko wesiVumelwano somLayelo weRoma we-ICC ngomnqopho wokuhlathulula nokuqinisa iimbopho zokubonisana nokusebenzisana ne-ICC emiBusweni enjalo.

Kuzakuthoma nokukhulumisana hlangana kwe-AU nemibuso ye-Afrika. URhulumende uzakukhetha isiqhema saboNgqongqotjhe abazakuthoma khonokho ukukhulumisana ne-ICC, ne-AU kunye nemibuso yamazwe we-Afrika. 

7. Ukuqatjhwa

Ukuqatjhwa koke kulawulwa kufakazeleka kweencwadi zefundo ezikhambisana nomsebenzi umuntu aqatjhelwe wona kunye nokuhlanjululwa kwegama lomuntu okufaneleko okwenziwa ziimphathimandla.
