National Prosecuting Authority on judgement on search warrants

Supreme Court of Appeal judgments on search warrants

8 November 2007

The Supreme Court of Appeal in Bloemfontein today handed down judgments in
respect of search warrant appeals lodged by both the Scorpions and other
parties involved in the matter. All of those four judgments were in favour of
the National Prosecuting Authority (NPA).

The NPA and the Scorpions are very please and welcome the said judgments.
Their significance is that they constitute a confirmation an a vindication that
the NPA and the Scorpions follow a rules book as it were, in carrying out its
duties. Furthermore, the rulings mean that a path has been cleared for the
Scorpions to proceed and to attend to other outstanding processes.

We wish to emphasise the fact that it is only at the conclusion of all other
outstanding processes that the NPA will pronounce on the next course of action.
The decision whether to prosecute or not to prosecute has not been taken by the
NPA on this matter.
