The Department of Transport notes and welcomes the Gauteng North High Court ruling regarding the management contract of the Electronic National Traffic Information System (e-NaTis) previously awarded to Tasima. The matter was heard by Judge W. Hughes and centered around the advertisement of eNaTis posts by the Road Traffic Management Corporation (RTMC), the transfer of the eNaTis services to the Department of Transport or the RTMC, continued payment to Tasima by the Department for the duration of a transfer management plan and the validity of the extension of the contract with effect from May 2010-2015.
Judge Hughes ruled in government’s favour and dismissed Tasima’s application as follows:
- The decision of the former Director General of the Department of Transport to approve and extend the eNaTis project for a 5-year fixed period is set aside.
- The extended contract that took effect on 1 May 2010 and expired on 30 April 2015 is declared void from date of extension.
- The department can request a transfer of the eNaTis system and related services within five days of the date of the order and the process should be completed within 30 days.
- The department is granted leave to approach the Court should Tasima commit any act intended to deliberately delay or frustrate the transfer process.
- Judge Hughes also ordered Tasima to pay the costs of the department in the main application.
- The Minister of Transport Ms. Dipuo Peters has welcomed the court ruling, hailing it as victory for taxpayers.
“The end of this tedious journey leaves us with several lessons with regard to prudent utilisation of public funds.
It also forces us to reflect on contract management, especially when it concerns contracts of this magnitude.”
