Independent Complaints Directorate (ICD) Investigation into
missing firearms and other matters at Durban Metro Police

The ICD's report into the aforesaid was released on 23 October 2006. That
report had in it recommendations that certain individuals within the Durban
Metro Police be investigated, with a view to bringing criminal and departmental
charges against them. While some recommendations were implemented, those
relating to the workshop and ammunition stores were largely ignored by the
Durban Metro Police Service (DMPS) management. The City Manager instead sought
to discredit the ICD's findings and recommendations. The ICD stands by its
findings.

On realisation that the DMPS management was not willing to implement our
recommendations, we decided to pursue further investigations, which included
obtaining a search warrant and subsequently seizing weapons and other
evidential materials. Further statements were obtained from a number of
individuals.

We have learnt with dismay that certain members of the Durban Metro Police
management, have tried to interfere with our investigations. We have learnt
further that the City Manager had also issued an instruction to the DMPS
management that they should not communicate and co-operate with the ICD
investigators.

The ICD wishes to state that in terms of Section 50(3) (b) of the South
African Police Service (SAPS) Act, criminal charges may be brought against
anyone interfering with its investigations. The ICD will thus avail itself to
use this legal tool as a necessary means to pursue its investigations to
finality.

Our investigation of certain members, including senior managers, of the
Durban Metro Police Service, is at an advanced stage.
