Although the North West Department of Public Works respects the independence
of the Judiciary, we have noted with concern nonetheless comments attributed to
the presiding officer in the matter between the State and Malebye as published
in âThe Mailâ of 21 July 2006.
At this stage, the department has not as yet studied the judgement,
therefore it is unable to comment on the findings.
For the record we wish to state that the decision to prosecute Mr Nchaupe
Solomon Malebye was solely the discretion of the Provincial Director of Public
Prosecution based on evidence presented before him.
The Public Financial Management Act obliges organs of state to report any
allegation and/or suspicion of financial irregularity to the South African
Police Service. In this matter, the Management of the Department acted in
compliance with obligatory provisions of the Public Finance Management Act and
not because of any vendetta against Mr Malebye.
