On Sunday, 23 September 2007, the President informed the National Director
of Public Prosecutions (NDPP) that he had decided to provisionally suspend him
in terms of section 12 (6)(a) of the National Prosecuting Authority Act (NPA
Act) of 1998. The section provides that the President can suspend the NDPP
pending the outcome of an enquiry into whether or not he is fit to continue to
hold office.
The NDPP indicated to the President that he accepts the decision.
The President has appointed Advocate Mokotedi Mpshe, one of the Deputy
National Directors of Public Prosecutions, as the Acting NDPP until the
finalisation of the enquiry process.
The management of the NPA has urged all members of staff to continue to
carry out their duties and to remain calm. The management is dealing with the
challenges posed by the suspension to the best of its ability. We trust that
the enquiry will be conducted expeditiously and fairly.
