National Energy Regulator (NER)

The NCOP today concurred with the Electricity Regulation Bill, which was
tabled to them by the Department of Minerals and Energy on 14 February 2006,
subject to minor typographical changes. The Bill comes as a result of and in
response to the expanding energy sector, which saw the National Energy
Regulator, Gas and Petroleum Pipe Lines Acts enacted. In addition the Bill
clarifies the role and powers of the NER South Africa, which comes into full
operation in April 2006.
Furthermore this Bill will repeal and replace the Electricity Act, which is
not in line with the Constitution, thus facilitating the restructuring in the
electricity industry while aligning the provision of the National Energy
Regulator Act.
The Bill in its current form does not provide for the regulation of
electricity reticulation, however, the amendment to this Electricity Regulation
Act will soon be tabled to the NCOP. Electricity reticulation will therefore be
dually regulated by municipalities and the National Energy Regulator.
The Bill will be debated at the NCOP on 16 February 2006.
