Labour on child labour law violations investigation

Year’s difference saves farmer from child labour rap

2 August 2006

The Reddersburg farmer in the Free State who was this week investigated for
alleged child labour law violations has been let off the hook after Labour
Department inspectors found that the boy he is employing is actually 16 years
old.

The employer was earlier this week ordered to release the boy from work
while the inspectors were verifying his age. Both Sectoral Determination No. 10
that regulates the employment of children and Section 43 of the Basic
Conditions of Employment Act outlaw the employment of any person under the age
of 15 to perform work that interferes with their welfare, health and
education.

The Free State livestock farmer has since been warned to adhere to the
prescriptions of Clause 25 of the Sectoral Determination for farm workers
requiring that the boy cannot work for more than 35 hours per week. The boy has
reportedly been employed to feed the farmer’s racing dogs at the property.
