As per Public Service Co-ordinating Bargaining Council (PSCBC) Resolution
one of 2007 no work no pay shall be applied by the employer in respect of the
recent strike action. Deductions of employees who were on strike for more than
four days will be staggered over a period of three months. It has been
determined that employees participated in strike action for 21 days. Deductions
for the first seven days will be effected in the August 2007 salary, that is 15
August 2007, for those who are paid on the 15th and 30 August 2007 for those
who get paid at the end of the month.
As far as the strike is concerned, it is presumed that, as the unions called
for the strike, all members of the respective unions had heeded the call and
participated in such action for the entire duration. In this regard, therefore,
automatic programmatic deductions of seven days per month beginning in August
2007 will commence in respect of all the affected union members.
However, should any employee wish to rebut the presumption that he or she
participated in the strike action for the full duration of the strike or that
they had indeed participated in the strike at all, each such employee is free
to provide sworn affidavits to the department in this regard. If any employee
indicates that he or she was not on strike but was indisposed due to ill
health, he or she is required to support such absence by providing a medical
certificate from a registered medical practitioner.
If there are other instances, other than those outlined in the previous
paragraph, why any employee did not report for duty during the whole or any
portion of the period of the strike, such instances must also be stated in the
form of a sworn affidavit.
