Call for illegal strike by Police and Prisons Civil Rights
Union (Popcru)

The directive issued by the National Commissioner ref 4/2/1 dated 18 May
2007 in the above-mentioned matter refers.

It has been established that the Police and Prisons Civil Rights Union at
it's congress has taken a resolution that should the negotiations on salaries
not be settled by end of business on 15 June 2007, then it's members will join
the strike undertaken by the unions of the public service.

I would like to take this opportunity to thank every employee of the service
for acting responsibly and with restraint throughout this period of the
industrial action by the public service.

I need to reemphasise the fact that the South African Police Service (SAPS)
as a whole is designated as an essential service in terms of Section 71 (10) of
the Labour Relation Act 1995. Employees of the service are by law prohibited
from engaging in strike action. Therefore any form of industrial action is
illegal.

Section 41 of the SAPS Act, 1995 (section 41) expressly prohibits members
from striking, or conspiring with another person to strike. A contravention of
this prohibition may lead to a summary dismissal.

In the light of the above, employees of the SAPS are required to fully
appreciate their responsibilities in this regard and the consequences of lack
of tendering the required service by members to the public.
