Blue Continent Products (Pty) Ltd ("BCP") informed the Delegated Authority
for the Horse Mackerel sector, Dr Monde Mayekiso, on 12 September 2006, that an
error had been made in relation to the score allocated to BCP for investment in
on-board or land-based processing facilities. BCP were allocated four points
for these criteria in the rights allocation process, but these points were not
awarded to BCP on appeal.
The Delegated Authority and the Minister instructed that the matter be
investigated. It appeared that an administrative/Information Technology (IT)
error resulted in the four points not being allocated to BCP. The Delegated
Authority and the Minister then sought legal advice on whether the allocations
may be amended in order to rectify the mistake. The advice obtained was to the
effect that the allocation may be amended.
In the result, BCP's total score was increased from 44,15 to 48,15. BCP's
quantum allocation was increased by 87 tonnes, while all of the other
applicants' allocations were reduced slightly to accommodate this increase.
Applicants that have already collected their permits will be required to
return these permits and collect revised permits based on the revised quantum
allocation. Permits that have not already been collected will be issued in
terms of the revised allocations.
