North West Provincial Government’s response to the Constitutional Court Judgement on the matter between the Government and Tsoga Developers

The North West Provincial Government has noted the judgment delivered by the Constitutional Court on our application for leave to appeal the High Court order granting Tsoga Developers permission to attach the province’s bank account with R30 million in it.

We are pleased that the judgment did not rule negatively on the merits of our case, but denied us leave to appeal only on the basis that we need to follow certain procedures.

The judgment confirms the correctness of the decision by the Provincial Government to challenge the questionable business practices, which were affecting government negatively. Including the fact that Tsoga did not have the  necessary grading for the contract.

It further confirms that the Provincial Government was justified to take the matter to court in order to test the legality of the transaction involving millions of Rand that formed part of the settlement we challenged.

The Constitutional Court’s pronouncement that the Provincial Government had prospects of winning Part B of the court challenge – which aimed to reverse the writ of execution that gave Tsoga access to the money in the state account - confirms that we acted correctly in mounting the legal challenge.

We have noted the malicious reporting by Independent newspapers – Sunday Independent and The Star – to personalise this court case as a battle between Premier Supra Mahumapelo and the late businessman Wandile Bozwana.

It is a shame that a newspaper of its caliber would fail to report the simple truth as required by the Press Code, but choose to use personalities to try and sell sensational stories masquerading as news. For the record, the Government of North West has been involved in a legal battle with Tsoga Developers way before Premier Mahumapelo was appointed in 2014.

The North West Provincial Government’s action is informed by our commitment to clean up corruption and/or maladministration, whether committed by this current administration or the previous one.

We further promise that the Provincial Government will be proceeding full steam to clean up the system, root out and expose corrupt practices and ensure the province restores its sense of pride among the people of North West.

The province is committed to clean, responsible, responsive and accountable government.
