Regional Commissioner of Gauteng, Advocate Tozama Mqobi found guilty

The Regional Commissioner of Gauteng, Advocate Tozama Mqobi, has been found guilty in six of the eight charges she faced in an internal disciplinary process.

The pre-dismissal arbitration facilitated by the General Public Service Sectoral Bargaining Council (GPSSBC) found Advocate Mqobi guilty on six charges that include: fraud, contravening housing policy, flouting Public Finance Management Act (PFMA) provisions governing among others fruitless and wasteful expenditure, as well as treating her subordinate in an unprofessional and humiliating manner.

Advocate Mqobi was found not guilty on two charges that related to unduly interfering with the Department of Public Works procurement processes and treating officials of the Department of Public Works in a disgraceful and deplorable manner.

Following this verdict, the employee and the employer are both given up to 21 October 2010 to submit any mitigating and aggravating factors respectively before the chairperson of the disciplinary hearing could determine the appropriate sanction.

Department has welcomed the decision of the arbitrator of the GPSSBC and believes the conclusion of the case is another testimony of its commitment to ensure good governance.
