Parliament welcomes Constitutional Court dismissal of Agang-SA application for direct access

Parliament welcomes the Constitutional Court’s dismissal today of the application from AGANG-SA for direct access to the Court.

AGANG-SA had applied to the Constitutional Court to hear their challenge to the scheduling of a motion of no confidence in the President. 

They also did not want Speaker of the National Assembly, Ms Baleka Mbete, to preside over debate on such a motion. 

They further wanted a secret ballot to be used if such a motion was put to the vote. Members of the National Assembly, in terms of the rules, vote if a division is called on a matter. The voting is registered and recorded electronically.

The Constitutional Court’s dismissal for direct access by AGANG-SA means that the party should approach a High Court first, should they wish to pursue the matters in their application.
