National Prosecuting Authority (NPA) provisionally withdraws charges against Wa Afrika and his co-accused

On 6 August 2010 Mr Victor Mlimi and Mzilikazi Wa Afrika appeared in Nelspruit regional court facing charges of fraud, forgery and uttering after being arrested by members of Mpumalanga General Detective Services and the Directorate of Priority Crimes Investigations (DPCI) and the case was postponed to 8 November 2010.

The case docket containing evidential material was submitted to prosecutors in the NPA. After perusing the case docket we are of the view that it is desirable that the matter be fully investigated prior to taking a decision on whether or not to prosecute.

We therefore deem it appropriate that the charges be provisionally withdrawn pending further investigations. Once investigations have been concluded, the docket will be re-submitted to the NPA.

Consequently, on Wednesday, 8 September 2010 we will recall the case and formally withdraw. The implication of this decision is that the state can reinstate the case when the said investigations have been concluded and after a decision is made to prosecute.

The extent of the investigations is such that we are not convinced that they will be fully completed by 8 November 2010.
