Mineral Resources on Mining Charter

As per the Government Gazette number 39350 dated 30th October 2015, the Department of Mineral Resources has been exempted from applying the provisions of section 10 (1) of the Broad Based Black Economic Empowerment Act, 2003, as amended (BBBEE Act), to the upstream petroleum and mining industries administered in terms of the Mineral and Petroleum Resources Development Act, 2002 (MPRDA).

This transitory measure is applicable for a period of 12 months pending the finalisation of review and alignment of the Mining Charter with the BBBEE Act and the DTI Codes.

In this regard the Mining Charter will remain in force and right-holders are expected to continue maintaining compliance with the obligations envisaged in the Mining Charter and the terms and conditions of their rights and applicable laws, pending finalisation of the review and alignment of the Mining Charter with the BBBEE Act and the DTI Codes.

The technical teams from the Departments of Mineral Resources as well as Trade and Industry are developing proposals for the alignment of the Mining Charter with BBBEE Act and the DTI Codes, and an update will be provided in due course.
