Labour on Thongathi mall non-approved architecture designs

A structural engineer who designed the doomed Thongathi Mall, Dr Andre Ballack from Axion Consulting Engineers testified before the Commission of Inquiry that although the project's architectural designs were not approved, he was assured by the contractor that the project plans were "to be approved".

Ballack testified during his cross-examination by the Inquiry's Presiding Officer, Phumudzo Maphaha that, while it bothered him that something was amiss, he was reassured during the project's weekly meetings that he should not be worried.

"In fact in one meeting I was told that drawings were approved," Ballack told the Inquiry. 

Gralio Precast is the developing company behind the construction of the fatal Mall. 

Ballack's testimony focused on the number of changes that were done during the construction until the fatal day. He told the Commission that changes done to the structure "were affecting its integrity". 

He also told the Commission that despite requesting concrete tests results, these were never forwarded to him. Ballack said contract owner, Jay Singh said the concrete strength was in accordance with his designs. 

He also told the Commission that he never authorised the casting of beams. 

Ballack was appointed in the project in November 2012. He boasts 33 years  of experience. He has a BSc in Civil Engineering obtained from Pretoria University; a Masters of Science In Engineering from the University of London; and a Masters of Commerce obtained from the University of Johannesburg. Ballack is also a member of Engineering Council of South Africa.

The Thongathi (Tongaat) Mall commission of Inquiry was appointed following the structural collapse of the Mall that led to the death of two workers and injury to 29. The Section 32 hearing, was instituted by the Department of Labour in terms of the Occupational Health and Safety Act - to gather evidence against parties whose negligence resulted in occupational injuries and death of workers.

The Commission continues tomorrow, 11 December with further cross-examination of Ballack.
