Issuing of a liquor licence to Club Temptation is a mistake

The representatives from the Liquor board in Gauteng have confessed to a mistaken issuing of liquor licence  to Club Temptation in Hill. 

This emanated after an intense deliberation between the Standing Committee on Petitions in the City of Johannesburg and the Petitions Standing Committee in the Gauteng Provincial Legislature. The reports received from the Johannesburg Metro Police (JMPD) and the Municipality provided contradicting measurements. 

The JMPD alluded that upon visiting the club after receiving complaints from the residents on the noise levels, they did not discover any disturbing acts and thus could not agree with the petitioners, whereas the Environmental Health Office in the municipality provided a report which stated that; upon inspection visits held at 01h30  in the morning of 3 November 2013, they discovered that the noise from the club were way above the allowed noise fraction measure which is 45 decibels, while at the club it was 85. 

The municipality also indicated that the venue in which the club is situated, contravenes the land use act and the conditions under which the rights of occupancy are concerned. This was according the evaluation of the nature of the building which is operating as a club.The members of the Liquor Board then declared that the initial information provided by the club owner upon application for a liquor licence was misleading .

“The licence has to be revoked with immediate effect and I don’t understand why they still possess it since the reports clearly state that there were irregularities in the issuing of the licence and the investigations conducted reveals it as such” said councillor Tshabalala from the City of Johannesburg.

“It is however a concern how many liquor outlets are operating illegally and at a highly disturbing rate. This has left the City of Johannesburg with a lot of work to investigate and relook at all the licences issued to liquor outlets by the Liquor Board and verify if the bylaw enforcements (jurisdiction, levels of noise, amusements laws etc.) stated by the City as conditions were complied with upon approval of licences,”  concluded the Hon. Lindi Lasindwa: Chairperson for the Petitions Standing Committee in the Gauteng Provincial Legislature.

More petitions on liquor outlets continue until 16h00.
