Application of Resolutions of the Security Council of the United Nations Act, 1993 (No. 172 of 1993)

  • to provide for the application in the Republic of certain resolutions taken by the Security Council of the United Nations; and
  • to provide for matters connected therewith.

BE IT ENACTED by the State President and the Parliament of the Republic of South Africa, as follows:-

Application of resolutions of Security Council of United Nations

1. (1) The State President may by proclamation in the Gazette declare that any resolution taken by the Security Council of the United Nations under the provisions of the Charter of the United Nations shall apply in the Republic to the extent specified in the proclamation, as from a date so specified, and such resolution shall be implemented in the Republic in such manner as the State President may so determine.

(2) A proclamation contemplated in subsection (1) may be amended, supplemepted or repealed by the State President by proclamation in the Gazette.

Tabling of proclamations

2. A proclamation issued by the State President under section 1 shall be laid upon the Table in Parliament in the same manner as the list referred to in section 17 of the Interpretation Act, 1957 (Act No. 33 of 1957), and if Parliament by resolution disapproves any such proclamation or any provision thereof, such proclamation or provision shall cease to be of force and effect, but without prejudice to the validity of anything done in terms of such proclamation or such provision before it so ceased to be of force and effect, or to any right or liability acquired or incurred in terms of such proclamation or such provision before it so ceased to be of force and effect.

Offences and penalties

3. Any person who contravenes or fails to comply with a provision of a proclamation contemplated in section 1 shall be guilty of an offence and be liable on conviction to a fine or to imprisonment for a period not exceeding 15 years.

Exemption from liability

4. The State shall not be liable for any loss or damage suffered by any person which is caused by or arises from or is in any way connected with any bona fide act performed in accordance with a resolution made applicable in the Republic under section 1.

Short title and commencement

5. This Act shall be called the Application of Resolutions of the Security Council ofthe United Nations Act, 1993, and shall come into operation on a date fixed by the State President by proclamation in the Gazette.
