The National Prosecuting Authority (NPA) has taken note of recent reports in
the media regarding the investigation into Mr Jackie Selebi. Although the NPA
does not normally comment on ongoing investigations, it does wish to clarify
some aspects of the investigation to avoid confusion.
Firstly, the NPA can confirm that it applied recently for subpoenas in terms
of section 205 of the Criminal Procedure Act for purposes of finalising
outstanding aspects of the investigation. The subpoenas relate to persons from
whom co-operation is sought, and they have been served on them.
The NPA will not provide the names of such persons as it believes that it is
their prerogative to do so. The NPA also denies strongly the suggestion that
the acting National Director of Public Prosecutions, Advocate Mokotedi Mpshe,
ever ordered a review of the subpoenas.
Without commenting on this particular case, the NPA wishes to point out that
it is quite proper for the NDPP to furnish the Minister of Justice and
Constitutional Development with reports as provided in section 33 of the NPA
Act. On such occasions the NDPP may be accompanied by members of his staff.
The NPA remains committed to commencing with trial on 14 April 2009 as the
case has already been placed on the roll of the Johannesburg High court. The
NPA will not comment on the other inaccuracies in the media reports.
